Home My Public Portal AboutORD14466 • BILL NO. 2008-121 SPONSORED BY COUNCILMAN Harvey ORDINANCE NO. l tt 0 4 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI,AUTHORIZING THE CITY COUNSELOR TO ACQUIRE CERTAIN PROPERTY BY PURCHASE OR BY CONDEMNATION. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council does hereby find, determine and declare it a public necessity to acquire certain property owned by Mary Ann Bibens and Reve H. Hammons, described more particularly in Exhibit A, which is attached hereto and by this reference incorporated herein as if more fully and completely set out. The purpose of acquiring this property is for constructing the project commonly known as Missouri River Greenway. The City Council further declares this to be a public use. Section 2. The City Council does hereby authorize the City Counselor to acquire said parcel(s) by purchase or condemnation, including the authorization to file a petition for condemnation and to pursue such condemnation. The price to be paid in the event of purchase is not to exceed the appraised value of the property by more than fifteen percent unless otherwise authorized by the Council. In the event of condemnation, the price to be paid shall be as set forth by the Court. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval.
