Mr. Garabedian stated a hearing has been scheduled on July 8, 2009 for Golden Pond Resident Care Corp. and passed out a copy of the application and a letter from Ms. Lazarus the Planning Director with her comments. He stated the Board will be asking the applicant to set aside money in the 53G account for engineering review of the traffic study and may also want to request some money for legal counsel review. The Board discussed requesting money for the 53G account. Mr. Barnes arrived at 7:20pm. Mr. Warren moved to request $5,000.00 from the applicant to deposit into the 53G account for engineering and legal review. The motion was seconded by Mr. Foster and passed unanimously. Board Reorganization and ZAC Appointment Mr. Garabedian stated it was time to reorganize the Board and formally appoint a Chairman. Vice Chairman, and Clerk. The Board discussed the positions. Mr. DiMascio moved to nominate Mr. Garabedian to continue as Chairman. The motion was seconded by Mr. Foster and passed unanimously. Mr. Foster moved to nominate Mr. Warren as Vice Chairman. The motion was seconded by Ms. Rose and passed unanimously. Mr. Warren moved to nominate Ms. Rose as Clerk. The motion was seconded by Mr. Barnes and passed unanimously. Ms. Rose moved to appoint Mr. Peirce to the Zoning Advisory Committee. The motion was seconded by Mr. Foster and passed unanimously. 7:35 PM Continuation of Public Hearing 7 Price Street — Pohl Marlo Pohl — Applicant Debbie Pohl — Applicant Members Sitting: Mr. Garabedian, Mr. DiMascio, Ms. Rose, Mr. Peirce, Mr. Barnes Members in Attendance: Mr. Foster, Mr. Warren, Ms. Clark Mr. Pohl stated they are interested in adding a 19 x 21 addition to their pre-existing non -conforming house and they would need a special permit for the change and side setback relief of 5 feet and a variance for over a 25% increase. He stated at the last hearing the Board had requested actual builders plans so he hired Janette Thomson and they have been working with her since April. He submitted design drawings to the Board. The Board reviewed the drawings. Mr. Garabedian stated the Board is more concerned with the outside dimensions rather than the inside. Mr. Foster asked if this was in the Historic District. Mr. DiMascio stated it was not. Mr. Garabedian asked if there were any public comments and there were none. Mr. Peirce moved to close the public hearing. The motion was seconded by Ms. Rose and passed unanimously. 8:05 PM Continuation of Public Hearing 24 Ash Street - Varner Curt Varner — Applicant Eve Varner —Applicant Members Sitting: Mr. Garabedian, Mr. Foster, Mr. DiMascio, Ms. Rose, Mr. Barnes Members in Attendance: Mr. Warren, Mr. Peirce, Ms. Clark Mr. Garabedian stated this was a continued public hearing as to get comments from the Fire Chief regarding access to the accessory family dwelling. He then read the letter from the Fire Chief. Mr. Kadlik suggested the accessory family dwelling unit have a separate street number which should be 24R Ash Street. He also suggested there be a separate phone number. The applicant submitted additional photos. Mr. Garabedian asked if there were any public comments and there were none. Board of Appeals June 24, 2009 Page 2 of 3 Mr. Foster moved to close the public hearing. The motion was seconded by Mr. Barnes and passed unanimously. Mr. Foster moved to grant a variance under 210-126 to allow the accessory family dwelling unit be detached from the main dwelling on a finding that hardship exists because both structures already exist. The motion was seconded by Mr. Barnes and passed unanimously. Mr. Foster moved to grant a special permit under 210-126 to allow for an accessory family dwelling with the standard conditions and the conditions that there is communications between the units, always a clear path maintained so emergency personnel can reach the unit, separate phone lines necessary for 911 purposes, and both the main unit and accessory family dwelling unit have street numbers visible from the street. The motion was seconded by Ms. Rose and passed unanimously. Mr. Foster moved to grant a special permit under 210-119 for side yard setback relief of 3 feet from the 10 foot requirement. The motion was seconded by Ms. Rose and passed unanimously. Mr. Foster left the meeting. 8:25 PM Administrative Session of the Board of Appeals 7 Price Street — Pohl Members Voting: Mr. Garabedian, Mr. DiMascio, Ms. Rose, Mr. Peirce, Mr. Barnes The Board discussed the proposed addition and the relief needed. Ms. Rose moved to grant a variance under 210-128B to allow an increase to a pre-existing non- conforming structure greater than 25% to the extent of not more than 400 square feet on a finding of hardship due to the size of the existing house being substantially undersized. The motion was seconded by Mr. Peirce and passed unanimously. Mr. Peirce moved to grant a special permit under 210-128 to allow a change to a pre-existing non- conforming structure to a similar use in accordance with the Plans attached on a finding the proposed changes to the property are not substantially more detrimental to the neighborhood on the condition that the homeowner contain additional runoff to his property. The motion was seconded by Ms. Rose and passed unanimously. Ms. Rose moved to grant a special permit under 210-119 for 6 feet of relief on the easterly side on a finding of an irregular shape, narrow, or shallow lot. The motion was seconded by Mr. Peirce and passed unanimously. Ms. Rose moved to adjourn the meeting. The motion was seconded and passed unanimously.
