RESOLUTION NO. 14-8826
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OPA- LOCKA, FLORIDA, APPROVING, SETTING FORTH AND
SUBMITTING TO THE ELECTORATE A PROPOSED CHARTER
AMENDMENT, AMENDING ARTICLE H OF THE CHARTER OF
THE CITY OF OPA- LOCKA, FLORIDA, BY LIMITING THE
TERMS OF OFFICE FOR THE MAYOR AND COMMISSION TO
EIGHT (8) CONSECUTIVE YEARS TO BE EFFECTIVE
RETROACTIVELY; CALLING AND PROVIDING FOR A
REFERENDUM SPECIAL ELECTION TO BE HELD ON
NOVEMBER 4, 2014, FOR THE PURPOSE OF SUBMITTING SAID
CHARTER AMENDMENT TO THE ELECTORATE AT SAID
REFERENDUM; FURTHER DIRECTING THE CITY CLERK TO
CAUSE A CERTIFIED COPY OF THE HEREIN RESOLUTION TO
BE DELIVERED TO THE SUPERVISOR OF ELECTIONS OF
MIAMI -DADE COUNTY, FLORIDA; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the Citizens of the City of Opa -locka have circulated a petition pursuant to
the Charter, believing that it is in the best interest of the City for a Charter Amendment to be
submitted to the electorate at referendum; and
WHEREAS, the Petition having been certified by the Supervisor of Elections to have
been signed by more than 10% of the registered voters of the City of Opa- locka, it is required by
law that the City Commission submit the issue to the electorate at a referendum; and
WHEREAS, the proposed amendment is set forth in final form in this resolution, to be
submitted to the electors of the City by means of the herein resolution; and

WHEREAS, the proposed Amendment shall be submitted to the electorate at a
referendum special election to be held on November 4, 2014, as called for and provided herein,
and shall become effective upon approval by the electors:
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA- LOCKA, FLORIDA:
Section 1. The recitals and findings in the preamble to this resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this section.
Section 2. Article II, Section 2.1 of the Charter of the City of Opa -locka is hereby
proposed to be amended by creating Sec. 2. 1.1 Term Limits as follows:
Section 2.1. - Election and Term of Office.
The commission shall consist of the mayor and four (4) commissioners elected from the
City at large in the manner and for terms provided for herein or until their successors have been
elected and take office.
Sec. 2.1.1 Term Limits
a) No person may appear on the ballot for re- election to the office of Mayor or City
Commissioner of the City of Opa -locka if, by the end of the current term of
office, the person will have served (or, except for resignation, suspension, or
removal, would have served) in office for eight (8) consecutive years.
b) For purposes of this section, service as a City Commissioner shall include any
service on the City Commission, regardless of whether the seats are specifically
designated, and regardless of whether a City Commissioner seeks to run for re-.
election to the City Commission from another designated seat.
c) The limitation on appearing on the ballot set forth in subparaluaph "a ", relating to
eight (8) consecutive years, shall not be extended by switching from Mayor to
Commissioner, or vice versa, or by running for different positions on the City
Commission, including Mayor.

d) If approved by the voters, this amendment shall take effect as of the November
2014 elections, and elected service prior to November 2014, shall be measured
retroactively from the elected official's first consecutive election as an elected
official of the City of Opa- locka.
NOTICE OF REFERENDUM SPECIAL ELECTION

PURSUANT TO RESOLUTION NO. 14 -8826
A Referendum Special Election will be held on November 4, 2014, from 7:00 a.m. to
7:00 p.m. in the City of Opa- locka, Florida, at the polling places in the several elections precincts
designated by the Board of County Commissioners of Miami -Dade County, Florida, as set forth
herein, unless otherwise provided by law, for the purpose of submitting to the qualified electors of
the City of Opa- locka, Florida, the following question:
Question 1: Shall Article II, Section 2. 1, of the City of Opa -locks Charter be amended to
create Section 2.1.1, which would limit the terms of office for the Mayor and City
Commissioners to eight (8) consecutive years, if by the end of the current term of office, the
person will have served in office for eight (8) consecutive years, to take effect as of November
2014, and be effective retroactively?

Section 3. The official ballot to be used at said election shall be in full compliance
with the laws of the State of Florida, and shall be in substantially the following form, to wit:

and to be effective retroactively.
Section 4. The City Clerk shall cause to be prepared absentee ballots containing the
question set forth in Section 3 above for the use of absentee electors entitled to cast such ballots
in said municipal election.
Section 5. JOANNA FLORES, the City Clerk of the City of Opa- locka, Florida, or
her duly appointed successor, is hereby designated and appointed as the official representative of
the City Commission of the City of Opa- locka, Florida, in relation to matters pertaining to the use
of the registration books and the holding of said special municipal election.
Section 6. The City Clerk shall deliver a certified copy of this Resolution to the
Supervisor of Elections of Miami -Dade County, Florida.
Section7. This Resolution shall become effective immediately upon its adoption.

Description: On May 30, 2014, Johnnie Mae Greene, Chairperson of the Committee to Amend the
Charter of the City of Opa -locka ref: term limits submitted 1000 petitions of which 582 were
certified by Miami -Dade County Elections Department. On July 9, 2014 a second batch with 297
petitions were submitted of which 185 were certified by Miami -Dade County Elections
Department. This brings the total number of certified petitions to 767. The Committee to Amend
the Charter of the City of Opa -locka has obtained petitions of ten percent of the qualified electors
of the City of Opa- locks.

(A) The Charter may be amended in accordance with the provisions of Section 5.03 of the Home
Rule Charter of Miami -Dade County. The City shall enact an ordinance to implement this
Article.
(B) If conflicting amendments are adopted at the same election, the one receiving the greatest
number of affirmative votes shall prevail to the extent of such conflict.

SECTION 6.02. MUNICIPAL POWERS.
Each municipality shall have the authority to exercise
all powers relating to its local affairs not inconsistent
with this Charter. Each municipality may provide for
higher standards of zoning, service, and regulation than
those provided by the Board of County Commissioners in
order that its individual character and standards may be
preserved for its citizens.
SECTION 6.03. MUNICIPAL CHARTERS.
A. Except as provided in Section 6.04, any
municipality in the county may adopt, amend, or revoke
a charter for its own government or abolish its existence in
the following manner. Its governing body shall, within 120
days after adopting a resolution or after the certification
of a petition of ten percent of the qualified electors of the
municipality, draft orhave drafted by method determined
by municipal ordinance a proposed charter amendment,
revocation, or abolition which shall be submitted to the
electors of the municipalities. Unless an election occurs
not less than 60 nor more than 120 days after the draft is
submitted, the proposal shall be submitted at a special
election within that time. The governing body shall make
copies of the proposal available to the electors not less than
30 days before the election. Alternative proposals may be
submitted. Each proposal approved by a majority of the
electors voting on such proposal shall become effective at
the time fixed in the proposal.
B. All municipal charters, amendments thereto,
and repeals thereof shall be filed with the Clerk of the
Circuit Court.
SECTION 6.04. CHANGES IN MUNICIPAL
BOUNDARIES.
A. The planning director shall study municipal
boundaries with a view to recommending their orderly
adjustment, improvement, and establishment. Proposed
boundary changes may be initiated by the Planning
Advisory Board, the Board of County Commissioners, the
governing body of a municipality, or by a petition of any
person or group concerned.
B. The Board of County Commissioners, after
obtaining the approval of the municipal governing
bodies concerned, after hearing the recommendations of
the Planning Advisory Board, and after a public hearing,
may by ordinance effect boundary changes, with an
affirmative vote of the members of the Board of County
Commissioners. In making such decision, the Board shall

166.031 Charter amendments. -
(1) The governing body of a municipality may, by ordinance, or the electors of a municipality may,
by petition signed by 10 percent of the registered electors as of the last preceding municipal general
election, submit to the electors of said municipality a proposed amendment to its charter, which
amendment may be to any part or to all of said charter except that part describing the boundaries of
such municipality. The governing body of the municipality shall place the proposed amendment
contained in the ordinance or petition to a vote of the electors at the next general election held within
the municipality or at a special election called for such purpose.
(2) Upon adoption of an amendment to the charter of a municipality by a majority , of the electors
voting in a referendum upon such amendment, the governing body of said municipality shall have the
amendment incorporated into the charter and shall file the revised charter with the Department of
State. All such amendments are effective on the date specified therein or as otherwise provided in the
charter.
(3) A municipality may amend its charter pursuant to this section notwithstanding any charter
provisions to the contrary. This section shall be supplemental to the provisions of ail other laws relating
to the amendment of municipal charters and is not intended to diminish any substantive or procedural
power vested in any municipality by present law. A municipality may, by ordinance and without
referendum, redefine its boundaries to include only those lands previously annexed and shall file said
redefinition with the Department of State pursuant to the provisions of subsection (2).
(4) There shalt be no restrictions by the municipality on any employee's or employee group's
political activity, while not working, in any referendum changing employee rights.
(5) A municipality may, by unanimous vote of the governing'body, abolish municipal departments
provided for in the municipal charter and amend provisions or language out of the charter which has
been judicially construed, either by judgment or by binding legal precedent from a decision of a court of
last resort, to be contrary to either the State Constitution or Federal Constitution.
(6) Each municipality shall, by ordinance or charter provision, provide procedures for filling a
vacancy in office caused by death, resignation, or removal from office. Such ordinance or charter
provision shall also provide procedures for fitting a vacancy in candidacy caused by death, withdrawal,
or removal from the ballot of a qualified candidate following the end of the qualifying period which
leaves fewer than two candidates for an office.

We, the undersigned, ANDREW S. HAGUE, County Judge, Substitute Member /Chairperson,
PENELOPE `I "OWNSLEY, Supervisor of Elections, Member, CARLOS GUZMAN, County Judge,
Alternate Member, constituting the Board of County Canvassers in and for said County, do hereby certify
that we met on the Fourteenth day of November, 2014 A.D., and proceeded publicly to canvass the votes
given for the offices, persons and charter amendment herein specified at the City of Opa -locka General
and Special Municipal Elections held on the Fourth day of November, 2014 A.D., as shown by the
returns on file in the office of the Supervisor of Elections. We do hereby certify from said returns as
follows:
For MAYOR the whole number of votes cast was 2,658 of which number
Dorothy Johnson received 965 Votes
Myra L. Taylor received 1,151 Votes
Rose Tydus received 542 Votes
For COMMISSIONERS the whole number of votes cast was 1450 of which number
Andre Faustin received 368 Votes
Timothy Holmes received 1,103 Votes
Deborah Sheffield Irby received 926 Votes
Terence Pinder received 1,053 Votes
