ORDINANCE NO. 14482 _
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 8 OF
THE CITY CODE BY REPEALING THE PRESENT ARTICLE V, ENTITLED "PROPERTY
MAINTENANCE CODE,"AND ENACTING A NEW ARTICLE V IN LIEU THEREOF ENTITLED
"PROPERTY MAINTENANCE CODE."
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. Chapter 8 (Buildings and Building Regulations), Article V (Proper
Maintenance Code), of the Code of the City of Jefferson, Missouri, is hereby amended, to read
as follows:
ARTICLE V.PROPERTY MAINTENANCE CODE
Sec.8-49. Adoption of the 2006 International Property Maintenance Code,Fourth Edition,
The 2006 International Property Maintenance code as published by the International Code
Council Inc.is hereby adopted and incorporated herein by reference as the property maintenance code
of the City of Jefferson,with the additions,insertions,deletions and changes contained herein.

Sec.8-50.Amendments,insertions and deletions to the Property Maintenance Code.
The following additions, insertions, deletions and changes in the International Property
Maintenance Code,2006 and contained in Ordinance No. 14482 shall be as set out below:
A. Definitions:
1. Wherever the word"municipality" is used in the Property Maintenance
Code,it shall be held to mean the City of Jefferson,Missouri.
2. Where the job title "code official" is used in the Property Maintenance
Code it shall be held to mean the Director of Community Development.
3. Wherever the term "department' is used in the Property Maintenance
Code it shall be held to mean the Department of Community Development.
4. Wherever the term "legal representative" is used in the Property
Maintenance Code,it shall be held to mean City Counselor for the City of
Jefferson,Missouri.
B. Delete Section 104.1 and insert in its place:
Section 104.1 Duties of the code official and his designated Housing
Inspector(s).
1. The Property Maintenance Code shall be enforced by the code official or
his designee.
2. The code official shall maintain or cause to be maintained a written record
of all inspections, violations and the disposition thereof and to prepare
therefrom an annual report containing all proceedings under this code to
be transmitted to the City Administrator of the City of Jefferson,Missouri.
C. Delete Section 106.4 and replace with the following:
Section 106.4 Penalties:
1. Any person who shall violate any of the provisions of the code hereby
adopted or fail to comply therewith,or who shall violate or fail to comply
with any order made thereunder, or who shall build in violation of any
detailed statement or specifications or plans submitted and approved
thereunder,or any certificate or permit issued thereunder,and from which
no appeal has been taken or who shall fail to comply with such an order
as affirmed or modified by the City Council or by a court of competent
jurisdiction,within the time fixed herein,shall severally for each and every
such violation and noncompliance respectively, be guilty of a
misdemeanor,punishable by a fine of not less than$25.00 nor more than
$500.00 or by imprisonment for no more than 180 days or by both such
fine and imprisonment. The imposition of one penalty for any violation
shall not excuse the violation or permit it to continue:and all such persons
shall be required to correct or remedy such violations or defects within a
reasonable time;and when not otherwise specified,each ten(10)days that
prohibited conditions are maintained shall constitute a separate offense.
2. The application of the above penalty shall not be held to prevent the
enforced removal of prohibited conditions.

D. Delete Section 111.1through 111.8,and insert the following:
Section 111.1 Means of Appeal:
1. Any owner,occupant,lessee,mortgagee,agent or other person
having an interest In the building or structure may appeal from the order
and determination of the building official. The appeal shall be to the
Circuit Court of Cole County as Established in Article 536 of the Revised
Statutes of Missouri.

Section 2: This ordinance shall be in full force and effect from and after the date of
its passage and approval.
