HomeMy Public PortalAboutORD14484 BILL NO. 2008-136 SPONSORED BY COUNCILMAN Penfold ORDINANCE NO. 14484 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 8 BY REPEALING THE PRESENT SECTION 8-4, ENTITLED "ADOPTION OF THE INTERNATIONAL PLUMBING CODE 2003 EDITION," AND SECTION 8-5, ENTITLED "AMENDMENTS TO THE INTERNATIONAL PLUMBING CODE 2003 EDITION," AND ENACTING NEW SECTIONS 8-4 AND 8-5 IN LIEU THEREOF. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Chapter 8 Buildin s and Building Regulations), of the Code of the City of Jefferson, Missouri, Section 8-4 Adoution of International Plumbing Code 2003 Edition), is hereby repealed, and a new Section 8-4 is enacted in lieu thereof, to read as follows: Sec.8-4. Adoption of the International Plumbing Code 2006. The International Plumbing Code/2006 published by the International Code Council, Inc.is hereby adopted and incorporated herein by reference as the Plumbing Code of the City of Jefferson,with the additions,insertions,deletions and changes contained in this ordinance. Chapter 8(Buildings and Building Regulations), of the Code of the City of Jefferson, Missouri, Section 8-5 Amendments to the International Plumbina Code 2003 Edition), is hereby repealed, and a new Section 8-5 is enacted in lieu thereof, to read as follows: Sec.8-5. Amendments to the International Plumbing Code 2006. The following addition,insertions,deletion and changes in the International Plumbing Code 2006 and contained in Ordinance No. 14484,shall be as set out below: Add Section 101.5: 101.5:The ordinances shall not be construed to relieve the responsibility or liability of any persons owning,operating,controlling or installing any plumbing or damage caused by any defect therein,nor shall the City of Jefferson or any of its inspectors,agents or employees,including its plumbing inspector,be held as assuming any such liability by reason of the inspection authorized herein or certificate of approval issued as herein provided. Delete Section 103.1, 103.2, 103.3 and 103.4 and insert in their place: 103.1 Plumbing Inspector: The administration and enforcement of the plumbing code shall be the responsibility of the Director of Community Development or designated Bill 2008-136 Page 1 representative,the Plumbing Inspector,who is authorized to take such action as may be reasonably necessary to enforce this ordinance. 103.1.1 Qualifications of Plumbing Inspector: The Plumbing Inspector shall be over twenty-one(21)years of age,be of good moral character,and be physically able to carry out all the provisions of the plumbing code. The Plumbing Inspector shall have six(6) years experience as a licensed journeyman in the trade,or have two(2)years training in a recognized college of Mechanical Engineering and in addition thereto,shall have a minimum of four (4) years of practical experience in plumbing construction. The Plumbing Inspector shall be a City of Jefferson licensed journeyman plumber,but shall not be actively engaged in the plumbing business,nor associated with the operation of any person,firm or corporation engaged in the plumbing business in Jefferson City. 103.2 Appointment of Plumbing Inspector:The Plumbing Inspector shall be appointed by the Director of Community Development. 103.2.2 Duties of the Plumbing Inspector:It shall be the duty of the Plumbing Inspector to enforce the provisions of the plumbing code and to make all inspections required thereunder,and to issue all permits,collect all fee's and keep all records required under this ordinance. All fees are to be credited to the General Revenue. The Plumbing Inspector shall also perform all tasks and services delegated by other ordinances or other supervisory personnel. Delete section 106.3 and insert in its place. 106.3 Permit Application:Application for permits for plumbing work shall be made on forms provided by the Department of Community Development. Delete 106.4 and insert in its place: 106.4 Permits: Plumbing permits shall only be issued to licensed plumbing contractors and approved qualified home owners. 106.4.1 Home Owner Permits:A permit may be issued to a qualified person to do work in a single family dwelling used exclusively for their living purpose,including the usual accessory building and quarters in connection with such buildings,provided that the person is the bona fide owner and shall occupy said dwelling for one(1)calendar year after date of approved final inspection of work covered by the permit. Owner shall purchase all materials and perform all labor to complete the plumbing installation. All work performed under this permit will comply to all Sections of this ordinance. Qualification shall be determined by a test of basic knowledge of plumbing principles. Delete 106.6.2 and insert in its place: 406.6.2 Fee Schedule. See Section 8-20. Delete Section 106.6.3 and insert the following in their place: 106.6.3: Permit fees shall be billed to licensed plumbing contractors the first of each month. Permit fees are due in month billed,a twenty-five dollar($25) past due shall be added to each permit fee not paid within sixty(60)days of first billing date. All permit fees and passed due fees not paid within ninety (90) days of first billing date can be collected from contractor's surety bond. Add to section 107.1,item(4)to the last paragraph: 107.1,(4): Notice of inspection; it shall be the duty of the permit holder to contact the Department of Community Development to arrange for each required inspection. The permit holder shall allow twenty-four(24)hours for the Plumbing Inspector or Code Enforcement personnel to conduct required inspections during the City's normal working hours. Delete Sections 109.2 thru 109.7 and insert in their place: Bill 2008-136 Page 2 109.2 Board of Plumbing Review and Examiners,Appointment and Term of Office: Division 2 of Article XIII,Chapter 7,establishes a board of plumbing examiners and review with attendant duties and powers. Whenever reference is made to the"board" in Section 8-4 of Chapter 8 of the Code of the City of Jefferson,Missouri,reference is to the board of plumbing review and examiners. (Ord.No. 11905,§8,5-17-93) 109.2.1 Duties of the Board: The Board shall act on grievances by an applicant for a plumbing permit,the holder of plumbing permit,or the owner and/or agent of a building or structure wherein plumbing work is to be installed. Such grievances shall be an appeal of the decision of the Plumbing Inspector or authorized agent or representative. Refusing to grant a modification of provision of the plumbing code governing the installations or materials to be used. Applications for appeal will be submitted to the Director of Community Development or an authorized representative,when it is claimed that: 1. The true intent of the plumbing code or rules adopted thereunder have been incorrectly interpreted. 2. The provisions of the plumbing code do not fully apply. At such time as the Board of Review and Examiners meet to act on such an appeal,the Plumbing Inspector shall not vote. If one of the members of said Board is the appellant, that member shall not vote. A simple majority of those voting shall constitute a qualified decision. In the event the voting members of the Board are evenly divided,the decision of the Plumbing Inspector shall be affirmed. The Board shall review all examinations and the plumbing code a minimum of once a year. They shall transmit to City Council any and all recommendations and/or changes necessary to update the plumbing code. 109.2.2 Meeting of the Board: The Board shall meet at such intervals as may be necessary for the proper performances,upon call of the Board chairman,but not less than twice a year. Minutes of meetings will be kept on file for Council review. 109.2.3 Licenses:No person,firm or corporation shall install,repair,alter,or extend any plumbing system within the City of Jefferson unless licensed as required in this ordinance. Plumbing System includes the water supply and distribution pipes;plumbing fixtures and traps;soil,waste and vent pipes,and sanitary and storm sewer and building drains;in addition to their respective connections,devices and appurtenances within a structure or premises and their extension to the purveyors or other water supply and the connection there to a point of disposal. 1. Exemptions: No license or permit is required for the performance of the following plumbing work: a) Water faucet repair/replacement b) Toilet tank fixtures repair/replacement C) Bathroom stool replacement d) Bathroom/kitchen drains unclogging (Ord.No. 12810,§2,9-8-98) Add 109.2.3.1 109.2.3.1 Application, Qualification and Fee for Licenses: Persons desiring a license shall complete and submit to the Plumbing Inspector an application for license. (Applications are obtained from the Department of Community Development). Add 109.2.4 109.2.4 Plumbing Contractor License:Persons desiring a Plumbing Contractor License shall be or employ full time a licensed Master Plumber and maintain a two thousand dollar($2,000)surety bond. Said bond shall indemnify and keep harmless the City of Jefferson from all liability from any accidents or damages arising from negligence or unskillfulness in doing or protecting work or any unfaithful or inadequate work done Bill 2008-136 Page 3 in pursuance of the Plumbing Business and that all street and right of way shall be restored to a condition acceptable to the City of Jefferson,Department of Public Works and shall maintain the acceptable condition for a period of one(1)year there after. This license is renewable annually for a fee of($200.00) two hundred dollars and shall be renewed during January of the following calendar year. Persons licensed as a Plumbing Contractor shall immediately notify the Plumbing Inspector,in writing,of any changes of name,address,phone number,or location of their plumbing business. Add 109.2.5 109.2.5 Master Plumber Licenses:Persons desiring a license shall have been licensed as a journeyman with the City of Jefferson a minimum of two(2)years or provide proof of licensed journeyman or master experience acceptable to the Board, and score a minimum of 75% on the Thomson Pro-Metric Testing Master Plumber Examination. This license requires a one hundred dollar($100.00)fee and is permanent unless revoked for cause. Add 109.2.6 109.2.6 Journeyman Plumbing Licenses: Persons desiring a license shall have been licensed as an apprentice with the City of Jefferson a minimum of four(4)years and shall have worked under the direct supervision of a licensed journeyman or master plumber during these four(4)years or show proof of four(4)years plumbing experience acceptable to the Board and score a minimum of 75% on the Thomson Pro-Metric Testing Journeyman Plumbers Examination. This license requires a one hundred dollar ($100.00)fee and is permanent unless revoked for cause. Add 109.2.7 109.2.7 Apprentice Plumber License:Persons desiring a license to work as an apprentice plumber shall submit their name,address,phone number and social security number with the ten dollar($10.00)fee to the Plumbing Inspector. This license is renewable each calendar year. Holder of an apprentice plumber license may only work under the direct supervision of a licensed master or journeyman plumber. The ratio of apprentices to journeyman or master is two(2)to one(1). Add 109.2.8 109.2.8 Licenses, Suspension or Revocation: The Board may suspend or revoke the license of any apprentice,journeyman,master or contractor plumber when charges are preferred against them by the Plumbing Inspector, and the Board finds the person charged is incompetent or had willfully violated the provisions of this ordinance. Prior to Board action, the person charged shall be given at least ten (10) days notice of the time and place of a formal hearing on said charges and the person charged shall be apprized of the charges. The person charged shall be given the opportunity to appear in person or with an attorney and shall have the burden of showing cause why the license should not be suspended or revoked. The Board shall render its decision within five(5)days. The decision shall be final,no appeal shall be allowed. The Board may drop the charges,suspend the license for such period deemed proper or permanently revoke the charged person's license. A person whose license has been revoked by the Board shall not be permitted to re-apply for a license for a period of one(1)year,and must successfully pass any required examination for the license. Add 109.2.9 109.2.9 Assignment of Contractor Licenses: No person licensed as a Plumbing Contractor shall allow this license to be used by others for the purpose of obtaining Plumbing Permits or knowingly allow non-licensed persons to do plumbing work. Add 109.3.0 109.3.0 Re-Examination: Persons who fail to pass the examination as prescribed may apply for re-examination after the expiration of one hundred twenty(120)days. Should applicant fail on re-examination,the applicant may not re-apply for a period of 120 days and shall be considered a new applicant. Bill 2008-136 Page 4 Add sentence to section 305.6: 305.6 Frost line in City of Jefferson,Missouri is considered(30 inches)(762 mm). Delete 305.6.1 and insert in its place: 305.6.1 Sewer depth: Building sewer that connects to private sewage disposal system shall be a minimum of 24 inches(610 mm)below finished grade at the point of septic tank connection. Building sewer shall be a minimum of 24 inches (610 mm) below finished grade. Add to 312.6 Gravity Sewer Test is not required. Add sentence to section 312.9.1 312.9.1 Testing back flow prevention assemblies shall be by City of Jefferson,Missouri licensed Journeyman or Master Plumber certified by the State of Missouri as back flow prevention assembly tester. Adds sentence to section 312.9.2 312.9.2 Inspection and testing of back flow prevention assemblies: After the required test of a back flow prevention assembly at time of installation,the testing requirements shall be the responsibility of the water purveyor. A valve shall not be installed down stream from an atmospheric-type vacuum breaker.Where chemicals are introduced into the system,the potable water shall be protected by a reduced pressure principle back flow preventer. Delete Individual Water Supply Sections 608.17.1 through 608.17.8.and replace with 608.17.1: 608.17.1: Wells shall be as currently required by the State of Missouri and U.S. Government(Federal)requirements. Add to Section 701.4 Sewage Treatment. 701.4.1: Private Sewage Disposal System shall be as currently required by the State of Missouri Department of Health 19CSR20-3.060 Minimum Construction Standards for on-site sewage disposal system.RSMo.701. Delete 708.3.5 and insert in its place 708.3.5: 708.3.5 Building Drain and Building Sewer Junction: There shall be a two way or double clean out at the junction of the building drain and the building sewer outside within five(5)feet of the structure unless a different distance is approved. The two way fitting with a single riser shall be installed up to finish grade level for installations two feet(2')or less. Two wyes and eighth bends(double clean out with wyes arranged so the entire piping can be cleaned)with risers up to finish grade level,for installations over two feet (2')deep. Plugs and caps shall be of approved type to serve each location. Delete 903.1 and insert in its place 903.1: 903.1 Main Vent Required: Minimum vent size required: Every drainage system receiving discharge of a water closet shall have a minimum of one-three inch(3")vent or the equivalent of three- two inch(2")vents connected to the drainage system and run as direct as possible through to the open air above the roof. 904.1 Roof extension insert 12 inches(30.48 mm). Delete Sections 917;917.1;917.2;917.3;917.3.1;917.3.2;917.4;917.5;917.6;917.7;and 917.8. Insert in their place 917: 917 Air Admittance Valve: Air admittance valve shall not be installed in the City of Jefferson,Missouri.Unless prior approval from the code official is given. Add 1003.3.2: 1003.3.2 Grease Interceptor Design: The inlet(effluent)shall be two inches(2")above the outlet(effluent). A center baffle shall run to within six inches (61) of the bottom inside and be sealed to the top and both sides. The outlet shall have a tee baffle with top open and the bottom extended to within six inches(61')of the bottom inside. The inlet shall have a%(90')bend sweep install with the open end down and extended down one foot-four inches(1'4"). There shall be a man hole or holes installed so the entire inside of the interceptor can be cleaned.
