CITY OF MEDINA
RESOLUTION NO. 96-2
RESOLUTION GRANTING CONDITIONAL USE PERMIT
REGARDING ACCESSORY STRUCTURES TO WES
SCHROEDER AND DIANE SCHROEDER
WHEREAS, Wes Schroeder and Diane Schroeder (the "Applicants") have requested
permission to increase the number of accessory structures on the property located at 3705 County
Road 19 by constructing a third accessory structure; and
WHEREAS, the city's zoning ordinance requires a conditional use permit in order to have
more than two accessory structures or when the cumulative area of the accessory structures
exceeds 3,000 square feet; and
WHEREAS, this matter was reviewed by the planning commission at its meeting of
December 12, 1995 and by the city council at its meeting of January 2, 1996; and
WHEREAS, it has been determined that the proposed new accessory structure on the
property will not impede the normal and orderly development of adjacent lands for purposes for
which they are zoned.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicants to allow construction of a
third accessory structure on the property, subject to the following conditions:
1. The new accessory structure shall be for personal use for the Applicants and shall
not be used by the Applicants in connection with any commercial activity on the
property;
2. Exterior lighting shall be designed and installed so that the globe is recessed and
enclosed on all sides except the bottom and no light is case directly on any other
property;

3. Manure must be removed from the site in accordance with the regulations of the
city and of the Minnesota pollution control agency;
4. The total area of the three accessory structures shall not exceed 7,000 sq. ft.; and
5. The Applicants agree to pay the city an administrative fee in the amount
determined by the staff to represent the actual cost to the city of reviewing this
application.

The motion for the adoption of the foregoing resolution was duly seconded by member
Anne Theis
and upon vote being taken thereon, the following voted in favor thereof:
John Ferris, Jim Johnson, Thies, Phil Zietlow and Mayor Theis.
and the following voted against same: None .
Whereupon said resolution was declared duly passed and adopted.
