RESOLUTION NO. 12-2010
A RESOLUTION ADOPTING AN ENFORCEMENT RESPONSE GUIDE (ERG) IN CONNECTION WITH CHAPTER 54 OF THE RICHMOND CODE OF GENERAL ORDINANCES
WHEREAS, Section 54.75 of the Richmond Code of General Ordinances provides that the Director of the Richmond Sanitary District shall prepare, for passage, by the Board of Sanitary Commissioners
of the Richmond Sanitary District, an Enforcement Response Guide (ERG) to insure that the requirements of the federal Clean Water Act will be met, to outline various administrative actions
the Director may take for various pretreatment violations, and to review and update the ERG to insure compliance with the Clean Water Act and Chapter 54; and
WHEREAS, Adoption of an Enforcement Response Guide (ERG) is also necessary for the enforcement of penalties for the violation of other sewer use ordinances in Chapter 54 of the Richmond
Code; and
WHEREAS, The attached Enforcement Response Guide (ERG) has been prepared and is submitted by the Director, and provides for the fair and efficient enforcement of the ordinances contained
in Chapter 54 of the Richmond Code.
NOW THEREFORE, BE IT RESOLVED by the Board of Sanitary Commissioners of the Sanitary District of Richmond, Indiana, that said Board adopts the attached Enforcement Response Guide (ERG).
BE IT FURTHER RESOLVED by the Board of Sanitary Commissioners of the Sanitary District of Richmond, Indiana, that the attached Enforcement Response Guide (ERG) take effect immediately
upon passage.
