Present: Mrs. Antiles and Messrs. Laikin, Printup, Sherman and Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Clifford Schulman, representing the Village Attorney. A public hearing was held on the final reading of the newsrack ordinance. Mr. Schulman read Ordinance No. 254 in full. Discussion followed on the weight limitations, chaining the racks together and placement inside the bus shelters. On motion of Mr. Printup, seconded by Mrs. Antiles and voted the ordinance was passed on second and final reading. Mr. Sherman reviewed the status of the Public Works facility and the need for the building and a superintendent's residence on the property. Mr. Desharnais, the Village Building Inspector, explained what he had done to bring the cost down to a resonable figure. Also discussed was the cost and installation of a standby generator for the water pumps and some electri- city to the village hall and shop. Mr. Whitman stated his objections to the use of that site for the building. Mr. Sherman said we have been discussing this for a whole year and have even hired a second architect to review the project. He recommended that we proceed with the steel building, which could be delivered in six to eight weeks. Mr. Maley said the piles must be driven prior to that date. It was moved by Mrs. Antiles, seconded by Mr. Printup and voted that the plans for the steel building be reviewed by Mr. Haynes' architectural firm and the council will listen to any comments Mr. Whitman wishes to make during that time. Mr. Maley reported that only one bid had been submitted for the storm drainage repairs in the residential district in the amount of $34,500. Our engineers had estimated the project at $21,500. On motion of Mrs. Antiles, seconded by Mr. Laikin and voted, the bid was rejected and Mr. Maley was authorized to rebid the work again. January 31, 1984 Mr. Maley explained that after the bids for the groin repair were re- jected Mr. Desharnais contacted another marine contractor. Mr. Joe Bunnell submitted a written proposal of $63,000 to put in the panels, which would be furnished by the village at a cost of about $12,000. The job had been originally estimated by the engineer's at $57,000. Inasmuch as the work cannot be done over the winter months it was moved by Mr. Printup, seconded by Mrs. Antiles and voted that the job be delayed until April. Mr. Maley is to get another opinion on the necessity to repair the groins. Mayor Sherman introduced Mrs. Monique de Vasjoli. Mrs. de Vasjoli is working on the French Fashion Show for the village at no cost to the Village. Mr. John Kelly, the Village's part-time Finance Director, told the council that he had met with Arthur Andersen & Co. and had completed his study of internal controls, for the village. Mr. Kelly reviewed his report, which had been submitted to the council. The council accepted Mr. Kelly's report. The council discussed various items in the Village Charter which are now in conflict with newer State Statues, particularly the schedule for budget adoption. It was suggested by the Village Clerk that the entire Code be looked at. It was moved by Mrs. Antiles, seconded by Mr. Taplin and voted that the village attorney check the Charter for conflicts. The council considered the first three months' operation statements. Mr. Kelly suggested a change in the statements received by the council to make them more concise. It was the consensus of the council that they would review the statements only quarterly. It was moved by Mr. Taplin, seconded by Mrs. Antiles and voted that the statements be approved and filed for audit. Mr. Maley explained that the streets in the single family Residential area are owned by the property owners, and that property ownership is no longer related to the Bal Harbour Club. He said he has been approached by members of the Civic Association regarding a special taxing district to pro- vide security guard services, which were previously furnished by the Club. He outlined the procedure, as stated in the Dade County Code, which would be followed. This includes a petition and an election, possibly by mail ballot. After discussion it was moved by Mrs. Antiles, seconded by Mr. Taplin, and voted that the concept is acceptable to the Council. Mr. Sherman said that Mr. Gutenstein has been transferred from the Sheraton Bal Harbour Hotel. The Resort Tax Advisory Committee agrees with the recommendation that the new General Manger, Mr. Jay Litt, be appointed to the Committee. It was moved by Mr. Taplin, seconded by Mr. Printup and voted that Mr. Litt be appointed to the Resort Tax Advisory Committee. Mr. Maley explained the Matching Funds advertising program between our Department of Tourism and the procedures of the Resort Tax. Matching Funds contracts for 1983-84 were presented and on motion of Mr. Taplin, seconded by Mr. Printup and voted the contracts were approved. The council discussed the problem of debris that gathers on the east side of Collins Avenue between the sidewalk and the property line. Mr. Maley said he would send letters to all property owners reminding them to have their employees clean the west side of their hedges and fences. January 31, 1984 Mr. Maley said that about 50% of the Balmoral owners had filed a protest with Dade County on their 1982 taxes. The Dade County attorney will be defending the suit, and asked if we wish to intervene. Mr. Schulman said that the Village might be drawn into the suit, but in the meantime his office will monitor the suit and inform the council. The Council declined to intervene. On motion of Mr. Printup, seconded by Mrs. Antiles and voted the meeting was adjourned at 12:15 P.M. Attest: Village Clerk January 31, 1984 COUNCIL MINUTES February 28, 1984 The Council of Bal Harbour Village met Tuesday, February 28, 1984 at 9:30 A.M. in the Village Hall. Present: Mrs. Antiles and Messrs. Laikin, Printup, Sherman and Taplin Also present were Fred Maley, Village Manager; Mary Wetterer, Village Clerk, and Alan Gold, Village Attorney. On motion of Mrs. Antiles, seconded by Mr. Printup and voted the minutes of January 31, 1984 were approved as submitted. Mr. Sherman said that the council had agreed that during the past month the plans for the Public Works facility would be reviewed by an outside architectural firm and that the council would consider any remarks Mr. Whitman cared to make regarding an alternate site for the building. Mr. Whitman told the council that he had met with his engineers, H. J. Ross Associates, Mr. Garrett Sloan; and two representatives from the Dade County Department of Environmental Resources Management on February 16, 1984. He gave the council copies of a memorandum of the items discussed and the resulting comments. Mr. Whitman said that these comments show that the Bal Harbour water tank could be removed from the present location on Village property. (Mr. Sherman left the meeting at this time.) Mr. Denham of H. J. Ross explained the items discussed at the meeting. He said they feel the tank is unreliable and could be removed so that the new building could be placed on its location. Mr. Maley and Mr. Wheldon, Superintendent of Public Works disputed the comment regarding the water pumps being out of service. Mr. Sherman returned to the meeting and advised that six months ago Mr. Sloan had advised the village not to remove the tank. He said he had just tried to reach Mr. Sloan for a clarification of his position, but he was not in the city. Discussion followed on use of the tank for February 28, 1984
