CITY OF MEDINA
RESOLUTION NO. 96-7
RESOLUTION VACATING A PORTION OF BEECHNUT
STREET
WHEREAS, the city council of the city of Medina (the "City") has received a petition
from a majority of the owners of land abutting a portion of Beechnut Street requesting that the
city vacate said street segment; and
WHEREAS, the legal description of the portion of Beechnut Street proposed to be vacated
is attached hereto as Exhibit A; and
WHEREAS, pursuant to Minn. Stat. § 412,851, the City scheduled a public hearing to
consider the vacation request; and
WHEREAS, the notice of said public hearing was published on January 25 , 1996, in
the official newspaper, was mailed to each owner of property affected by the proposed vacation
at least 10 days before the hearing and was posted in the area of the affected property at least
two weeks prior to the public hearing; and
WHEREAS, on February 20, 1996, the city council held the public hearing on the
proposed vacation of a portion of Beechnut Street, at which hearing all interested parties were
heard with respect to said vacation; and
WHEREAS, following said public hearing, the city council determined the vacation of
said street segment to be in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The city council hereby declares that the portion of Beechnut Street legally
described on Exhibit A attached hereto is vacated.

2. The city clerk -treasurer is authorized and directed to prepare and present to
Hennepin county a notice that the city council has completed these vacation
proceedings and request that the same be reflected in the county's records.

The motion for the adoption of the foregoing resolution was duly seconded by member Anne
Theis and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Jim Johnson, Ann Thies, Phil Zietlow and Mayor Theis.
and the following voted against same: None .
Whereupon said resolution was declared duly passed and adopted.

EXHIBIT A
The legal description of the vacated portion of Beechnut Street:
The east 290 feet of that part of Beechnut Street lying west of the line drawn from the southeast
corner of Block 9 to the northeast corner of Block 14, Independence Beach, Hennepin County.
