CITY OF MEDINA
RESOLUTION NO. 96-8
RESOLUTION VACATING A DRAINAGE AND UTILITY
EASEMENT FOR THOMAS WELLHAUSEN
WHEREAS, the city council of the city of Medina (the "City") has received a petition
from the fee owner of the property legally described as Lot 1, Block 1, Walnut Estates, Hennepin
County, Minnesota requesting that the City vacate the five foot drainage and utility easement
along the southerly line of said lot; and
WHEREAS, the legal description of the portion of the drainage and utility easement
proposed to be vacated is attached hereto as Exhibit A; and
WHEREAS, pursuant to Minn. Stat. § 412,851, the City scheduled a public hearing to
consider the vacation request; and
WHEREAS, the notice of said public hearing was published on the 22nd day of
February , 1996 in the official newspaper, was mailed to the owner of the affected property
at least 10 days before the hearing and was posted in the area of the affected property at least
two weeks prior to the public hearing; and
WHEREAS, on the 6th day of March, 1996, the city council held the public hearing on
the proposed easement vacation at which hearing all interested parties were heard with respect
to said vacation; and
WHEREAS, following said public hearing, the City determined the vacation of the
described portion of the drainage and utility easement to be in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:

1. The City hereby declares that the portion of the drainage and utility easement
legally described on Exhibit A attached hereto is vacated.
2. The city clerk -treasurer is authorized and directed to prepare and present to
Hennepin county a notice that the City has completed these vacation proceedings
and request that the same be reflected in the county's records.

The motion for the adoption of the foregoing resolution was duly seconded by member Anne
Theis and upon vote being taken thereon, the following voted in favor thereof:
John Ferris, Jim Johnson, Ann Thies, and Mayor Theis.
and the following voted against same: None.
Whereupon said resolution was declared duly passed and adopted.
