HomeMy Public PortalAbout1996-012Member John Ferris introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 96-12 RESOLUTION GRANTING AMENDED CONDITIONAL USE PERMIT TO MARK ROSKOP FOR A MINI STORAGE FACILITY WHEREAS, On October 17, 1995, pursuant to Resolution No. 95-52, the Medina city council granted permission to Mark Roskop (the "Applicant") to construct a mini storage facility on property located at the intersection of Rolling Hills Road and T.H. 55; and WHEREAS, pursuant to that approval, the Applicant and the city entered into a Site Improvement Agreement whereby the Applicant agreed to post with the city a letter of credit in the amount of $121,050; and WHEREAS, the Applicant posted a letter of credit in that amount and has proceeded to construct one of the buildings in the mini storage development and a portion of the associated site work; and WHEREAS, the Applicant has requested the flexibility to develop the project in phases and to be required to post a financial guarantee only large enough to pay for the site improvements associated with each phase. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that an amended conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The Applicant must work with the city engineer regarding a four foot drainage outlet structure; 2. Spruce trees must be used in the landscaping of the site; RHB102140 ME230-230 3. PCV must be used under the driveway and geotextile fabric under the parking lot area; 4. The opening on the south side of the site and the opening at the driveway must be fenced; 5. Exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or on any right-of-way; 6. All landscaping must be installed at the time of construction of the first building. All landscaping must be maintained and replaced if it dies; 7. There shall be no loudspeakers or telephone bells on the site; 8. All signs on the property must meet city code requirements; 9. The hours of operation shall be 6:00 a.m. to 10:00 p.m. daily; 10. There shall be no exterior storage permitted on the site; 11. There shall be no exterior trash containers on the site; 12. The Applicant must post with the city a letter of credit in an amount determined by the city engineer to represent 150% of the estimated cost of site improvements associated with each phase of the project. The Applicant may not proceed to construct subsequent phases until he has obtained the necessary building permit and has posted an additional letter of credit; and 13. The Applicant must pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota, that this resolution shall supersede and be substituted for Resolution No. 95- 52.
