CITY OF MEDINA
RESOLUTION NO. 96-14
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL
TO DONALD LAURENT FOR SOUTH CREEK ADDITION
WHEREAS, Donald Laurent (the "Applicant") has requested permission to plat
approximately 70.55 acres into 5 lots; and
WHEREAS, the preliminary plat was reviewed by the planning commission on March 12,
1996; and
WHEREAS, the city council has reviewed the preliminary plat for its conformance with
city ordinances.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that preliminary approval is hereby granted to the Applicant for South Creek
Addition, subject to the following conditions:
1. The Applicant must inform those who acquire title to Lots 1 through 4, Block 1,
that basement elevations of the houses to be constructed on those lots must be a
minimum of 4 and 1/2 feet above the elevation of the sewer invert;
2. The final plat must be in compliance with the requirements of the Elm Creek
Watershed District;
3. The final plat must be contain all easements required by the city engineer,
including drainage and utility easements 5 feet in width along interior lot lines and
10 feet in width along Hamel Road, and a drainage easement over the creek;
4. The Applicant must grant to the city a 10 foot easement for trail purposes over
Lots 1 through 4, Block 1;
5. The Applicant must pay park dedication fees on Lots 1 through 4, Block 1 in the
amounts determined by the city assessor;

6. The Applicant must inform those who acquire title to Lots 1 through 4, Block 1
that the location of driveways for those lots must be approved by city staff prior
to issuance of a building permit;
7. The Applicant must inform those who acquire title to Lots 1 through 4, Block 1
that there exist only three water services for the four lots and that one lot will
require construction of a new service from the water main on the north side of
Hamel Road. The city will require a permit for said service and that it be
installed in accordance with city requirements;
8. The Applicant must inform those who acquire Lots 1 through 4, Block 1 that the
city will collect sewer and water charges at the time building permits are issued
for houses on those lots;
9. The final plat must be in substantial compliance with the preliminary plat and the
terms of this resolution;
10. The final plat must be submitted to the zoning administrator for approval within
180 days of the date of this resolution; and
11. The Applicant must pay to the city an administrative fee in the amount sufficient
to reimburse the city for the cost of reviewing this application.

The motion for the adoption of the foregoing resolution was duly seconded by member
Ann Thies and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Jim Johnson, Thies, Phil Zietlow, and Mayor Anne Theis.
and the following voted against same: None.
Whereupon said resolution was declared duly passed and adopted.
