I1. CALL TO ORDER:
CITY OF TEMPLE CITY
CITY COUNCIL
MINUTES
NOVEMBER 16, 1982
•
Mayor Tyrell called the regular meeting of the City Council to
order at 7:30 p.m. on Tuesday, November 16, 1982, in the Council
Chamber of City Hall.
2. The invocation was given by Reverend Mike Gleason, First Baptist
Church of Temple City, 6019 N. Baldwin Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell.
4. ROLL CALL:
Present: Councilmen- Atkins, Dennis, Gillanders, Swain, Tyrell
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Kimbrough, Parks and Recreation Director
Kobett, and Planning Director Shaw.
At this time, Mayor Tyrell welcomed and introduced Sheriff Shermon
Block and Undersheriff Theodore Von Minden. Mayor Tyrell thanked them
for coming. Mayor Tyrell then presented Sheriff Block with his own
Chief of Police Badge, honoring him as "Chief of Police" for the
City of Temple City. He thanked the Sheriff for all he has done
over the past 27 years in the Sheriff's Department.
Sheriff Block expressed his thanks stating that this was a pleasant
surprise and honor. He commented on the excellent communications
between Temple City and the Sheriff's Department which has come
about through activities such as the monthly Sheriff's Breakfast.
He stated that he looked forward to continuing the kind of relation-
ship that has been established between the Sheriff's Department and
the City of Temple City.
5. CONSENT CALENDAR
Councilmans Gillanders and Swain requested that Item 5(I) be removed
from the Consent Calendar; Councilman Gillanders also requested that
Item 5(M) be removed from the Consent Calendar; and Councilman Swain
also requested that Item 5(B -1). be removed from the consent Calendar.
On motion by Councilman Atkins, seconded by Councilmand Gillanders,
all other items on the Consent Calendar were approved as recommended.
A. APPROVAL OF MINUTES - Regular Meeting of November 2, 1982.
Approved as written.
C. RECOMMENDATION FROM PARKING COMMISSION - Meeting of November 10,
1982 - AGREEMENT TO CROSS OVER PEDESTRIAN MALL NO. 4 - CHRISTY
WILLIAMS, 96591 LAS TUNAS DRIVE
Approved request subject to executing an' agreement with the City
and meeting said requirements of the agreement.

E ACCEPTANCE OF SANITARY SEWER - AGNES AVENUE PROJECT -
PRIVATE CONTRACT NO. 80 -1
Approved the work and accepted the sewer as complete; and accepted
for public use the sanitary sewer offered for dedication by John
Hibbard.
F ACCEPTANCE OF WORK: STREET IMPROVEMENTS - CAMINO REAL ET AL
Accepted the work performed under the contract and authorized payment
to J.E.G. Construction in the amount of $5,030,02 02 • authorized
filing Notice of Completion and release of the retention at the
end of the 35 -day lien period.
G. STREET LIGHTING PROJECT: SANTA ANITA AVENUE, LIVE OAK TO GRAND AVENUE
Approved plans and specifications and approved agreement with the
County of Los Angeles assigning an additional $74,500 in FAU funds
to the County to cover the remaining estimated cost of the project.
H BUDGET AMENDMENT RE: LAW ENFORCEMENT
Approved appropriation of $3,400 from the Contingency Balance to
Account No. 3003A to cover the cost of Neighborhood Watch overtime,
and appropriation of an additional $24,683 to General Law Enforcement
along with the remainder of the Contingency Balance to cover the
cost of Deputy training.
J. POTENTIAL ANNEXATION: TRADEWINDS APARTMENT, 5351 ROSEMEAD BOULEVARD
Authorized City staff to continue with the annexation.
K. RESOLUTION NO. 82- 2116: ANNEXATION 82 -1

CONSENT CALENDAR ITEM B(1) - PLANNING COMMISSION ACTION: Regular
Meeting of November 9, 1982 - REGARDING APPROVAL OF 99 -BED EXPANSION
TO THE EXISTING SANTA ANNITA CONVALESCENT HOSPITAL AND A REDUCTION
IN THE NUMBER OF PARKING SPACES
Councilman Swain stated that since the City Council, prior to the
meeting, received a petition with 43 signatures opposing the expansion
of the hospital, the City Council should consider appealing the
Planning Commission action. Councilman Swain moved to appeal Planning
Commission Resolution No. 82- 1034PC and set public hearing December 7,
1982, seconded by Councilman Gillanders and carried.

CONSENT CALENDAR ITEM I - PROGRESS PAYMENT: OLYMPIA SALES
Councilman Swain inquired as to why the curb numbers in the 5800
block of Agnes were painted on the tops of the curbs. City Manager
Koski asked Assistant City,Manager Kimbrough to report on the
problem. In responding, Assistant City Manager Kimbrough explained
that the height of some of the curbs in the City were not tall
enough to take the normal size numbers used on the curbs for the
project. He further explained that smaller numbers were purchased
and were apparently still too large for the curbs on Agnes. City
Manager Koski asked that Assistant City Manager Kimbrough verify that
the smaller numbers were still too large for the curbs on Agnes
and to report back to him once he completed the investigation.
Councilman Gillanders inquired as to why the City was paying the
64 .640 corrected numbers. City Manager Koski explained that the
incorrect numbers were never paid for, and since they had been
corrected, the City was now paying for them for the first time.
Councilman Atkins moved to approve progress payment in the amount
of $2,710.05 to Olympia Sales for the curb address project seconded
by Councilman Dennis and carried.
CONSENT CALENDAR ITEM M - RESOLUTION NO. 82 -2118: WARRANTS AND
DEMANDS
Councilman Gillanders inquired regarding Check Number 4858 in the
amount of $2,314.70 paid to the Hanalei Hotel as to why the City
was still making payment for hotel accommodations. City Manager
Koski explained that the City Council had previously approved
accommodations at this hotel, and had only paid a deposit, and
that this was the last payment due. Councilman Tyrell moved to
approve Resolution No. 82 -2118 A.RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM. OF
$76,845.90, DEMAND NOS. 4842 THRU 4913 seconded by Councilman Dennis
and carried on a roll call vote.

6. UNFINISHED BUSINESS:
A. PUBLIC HEARING: 7:30 p.m. TENTATIVE TRACTS NO. 36735 AND 37580
City Manager Koski presented background information stating that the
Planning Commission, at their regular meeting held October 26, 1982,
adopted Resolutions No. 82- 1032PC and 82- 1033PC recommending
approval of Tentative Tracts 36735 and 37580 respectively, for
13 and 19 lots. Additional action on an EIR was unnecessary per
Section 15067 of CEQA Guidelines, as a full EIR had been previously
prepared and approved on this project in 1979. The proposed lot
configuration is essentially identical to previously approved
Tentative Tract No. 36735 which was twice extended and eventually
expired on September 16, 1982.
Mayor Tyrell declared the public hearing open and invited anyone
wishing to speak to come forward.
Mr. George Weigand, Jr., 1425 Melanie Lane, Arcadia, the developer,
stated that he had no problem accepting the conditions except the
landscape condition 9J in Resolutions No. 82- 1032PC and 82- 1033PC
and the designing and installation conditions regarding undergrounding
of utilities.
Mr; Weigand explained that often when the developer installs the
landscaping, the buyer of the lot removes it to put in his own
landscaping. Councilman Gillanders questioned whether the land -
scaping condition, 9J, was part of the original conditions or whether
it was added. Mr. Weigand responded that the condition had been added.

Councilman Dennis then inquired as to how many of the homes were presold,
and Mr. Weigand told him than none of them were sold, but that
he would maintain them until they were sold. Councilman Swain
expressed her opinion that often buyers, after moving into a new
home, spend most of their money on the interior of the home first
and not the yard. Mr. Weigand further explained that he is
at the site everyday and because he is a small developer can see
that the places are kept up thus preventing an eyesore.
Mr. Weigand then went on to express his concern regarding condi-
tions 18, 19, 20, and 21 in Resolution No. 82- 1032PC and Items 19,
20, 21, and 22 in Resolution No. 82- 1033PC regarding the design,
installation, and coordination of all underground systems. He
explained that these companies are in the business to install and
design their own systems and that he would be glad to have the
trenches ready for the installation of the utilities, but was
concerned as to the utility companies and their timeliness and
the liability he would possibly incur if any injury occurred due
to an open trench. Councilman Gillanders commented that he
concurred with Mr. Weigand's concerns since the experience with
Falcon Cable Television in getting jobs done on time has not been
a good one. City Manager Koski stated that it is the responsibility
of the developer to see that the underground utilities are installed.
Mayor Tyrell commented that the developer could really only be
responsible for providing for the trenching and that he concurred
with Mr. Weigand s concerns regarding being liable for open
trenches.
There being no one else come forward to speak, Councilman Gillanders
moved to close the public hearing, seconded by Councilman Atkins
and carried.
Councilman Atkins suggested that the wording on the items regarding
the conditions on undergrounding be changed to "provide for" rather
than design and installation of all underground systems.
Councilman Atkins moved to acknowledge the existing approved EIR
seconded by Councilman Gillanders and carried.
Councilman Atkins moved to adopt Resolution No. 82 -2121 A RESOLUTION
OF THE CITY COUCIL OF THE CITY OF TEMPLE CITY APPROVING TENTATIVE
TRACT 36735 AND CONFIRMING PLANNING COMMISSION RESOLUTION NO. 82-
1032PC WITH MODIFICATIONS and Resolution No. 82 -2122 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING TENTATIVE
TRACT 37580 AND CONFIRMING PLANNING COMMISSION RESOLUTION NO. 82-
1033PC WITH MODIFICATIONS seconded by Councilman Gillanders and
carried.
B. PUBLIC HEARING: 7:30 p.m. STREET LIGHTING IMPROVEMENTS - LA ROSA
DRIVE: AGNES AVENUE TO BALDWIN AVENUE (Pursuant to Chapter 27,
Improvement Act of 1911, Streets and Highways Code)
City Manager Koski presented background information, stating that
the City Council at their regular meeting of November 2, 1982, set
a public hearing for theinstallation of four street lights, three
on wood poles and one on a marbelite pole, with overhead service.
The petition for the street lights was returned with the approval
of property owners representing 79.87 of the front footage of the
block. The total percentage exceeds the 607 requirement under
Chapter 27 proceedings. The upgrading of lighting will require
annexation into Zone A of the municipal lighting district, and
property owners are aware of the difference in rates between Zone B
and Zone A.._ A Negative Declaration of Environmental Impact was
prepared on October 21, 1982, in accordance with the requirements of
the California Environmental Quality Act. Property owners have
been notified of the public hearing pursuant to Chapter 27, the
Improvement Act of 1911.
Mayor Tyrell declared the public hearing open and invited anyone
wishing to speak to come. forward. There being no one come forward
to speak, Councilman Dennis moved to close public hearing seconded
by Councilmand Gillanders and carried.

Councilman Atkins moved to approve Negative Declaration seconded
by Councilman Gillanders and carried.
Councilman Atkins moved to approve Resolution No. 82 -2119 A RESOLU-
TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING THE
CONSTRUCTION OF CERTAIN IMPROVEMENTS PURSUANT TO SECTION 5870 ET.
SEQ. OF THE STREETS AND HIGHWAYS CODE seconded by Councilman
Gillanders and carried.
PUBLIC HEARING: 7:30 p.m. STREET LIGHTING IMPROVEMENTS - PERSIMMON
AVENUE: GRAND AVENUE TO FAIRVIEW (Pursuant to Chapter 27,
Improvement Act of 1911, Streets & Highways Code).
City Manager Koski presented background information, stating that
the City Council at their regular meeting of November 2, 1982,
set a public hearing for the installation of four street lights
to be installed on marbelite poles with overhead service. The
petition for street lights was returned with the approval of

block. The total percentage exceeds the 607 requirement under
Chapter 27 proceedings. The upgrading of lighting will require

and carried.
7. NEW BUSINESS:
None.
8. COMMUNICATIONS:
A. City Council received letter from Chamber of Commerce
commenting on the success of the Halloween Hoedown. The
Chamber, in their letter, requested Council's permission to
have 1 or 2 more street closures each year for similar events.
The matter was referred to staff for investigation and
Council consideration at a later time.
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
No one came forward to speak.
RECESS TO CRA:
At this time, Council recessed to meet as the Community Redevelopment
Agency, all members being present, approved the minutes of the regular
meeting of November 2, 1982, and approved the signs on the south and east
elevations and the "ALWAYS OPEN" sign pursuant to Sign Plans "A" and "B"
of Denny's Restaurant. The minutes are set forth in full in the records
of the Agency.

10. ACTION ON REQUEST BY CRA:
There was no action to be taken.
11. MATTERS FROM CITY OFFICIALS:
A. Disposal of Street Name Signs
City Manager Koski presented the recommendation from the staff
for the disposal of the old street name signs. Mayor Tyrell moved
to approve the disposal of street name signs per staff memo seconded
by Councilman Gillanders and carried.
B. Payment of Block wall between Residences - Edwards Theatre
Development
City Manager Koski presented request from Gene's Masonry for
payment of $522.00 for work completed on the block wall separating
the residences at 5802 N. Myda and 5829 N. Sultana Ave. Mayor
Tyrell moved to approve the request for payment seconded by
Councilman Gillanders and carried.
C. City Telephone System
Councilman Dennis inquired as to the staff memo dated November 11,
1982, concerning the upgrading of the City telephone system. The
City Manager indicated that the matter was being brought to the
Council's attention at this time as part of the planning for
the County Engineer building. Councilman Gillanders stated that he
could make arrangements for Council to see the telephone system in
operation if they desired. No further action was taken at this
time
D. Councilman Atkins commented that at this time the City Council
of the City of Arcadia was contemplating on what to do about
their problems with the flocks of parakeets throughout the City
of Arcadia. Councilman Atkins added that the parakeets in Temple
City were well -liked and that Temple City did not view them as
a problem.
E. Councilman Gillanders stated that he wished to meet with City
Attorney Martin at the close of the meeting to discuss the request
by the Chamber of Comerce to close the streets.
F. Councilman Swain expressed 'her respect for the new. Urgent Care
facility on Las Tunas. She stated that her family, over the week-
end, had cause to use the facility on an emergency basis, and
that the care was excellent and the staff courteous.
G. Mayor Tyrell reminded the Council that the Sheriff's Monthly
Breakfast meeting would be held next Wednesday, November 24,
1982, due to the Thanksgiving Day Holiday.
H. Mayor Tyrell stated that the City of Arcadia and the American
Cancer Society were holding a GREAT AMERICAN SMOKEOUT JUBILEE, on.
Wednesday, November 17, 1982, at Santa Anita Fashion Park from
2:00 p.m. to 3:00 p.m.
I. Mayor Tyrell informed the Council that Loma Linda University
was sponsoring medical examinations and tests at the Temple City
Seventh -day Adventist Church, 9664 East Broadway, Temple City,
on Sunday, November 21, 1982.
12 ADJOURNMENT
On motion by Councilman Atkins, seconded by Councilman Gillanders,
meeting adjourned at 8:35 p.m. Next regular meeting of the City
Council will be heard Tuesday, December 7, 1982, 7:30 p.m. in
the Council Chamber of the City Hall.
