HomeMy Public PortalAboutRES-CC-1978-07CITY OF MOFB Resolution V-78 AGREEMENT AND RESOLUTION TO THE AMENDED INTERLOCAL AGREEMENT OF THE UTAH LOCAL GOVERNMENT TRUST �s 1`7V WHEREAS, the '-� (hereinafter "Member") , a political subflivisio , of the State o tah, desires to become a member and to participate in the mended Interlocal Agreement of the Utah Local Government Trust (hereinafter "Trust), a governmental entity created by units of local governments pursuant to the Utah Interlocal Cooperation Act, sections 11-30-1 et seq. , Utah Code Annotated 1953, as amended. WHEREAS, the purposes of the Trust are: I. To enable local governments to act as a single their employees with hospital, dental, medical, disability, sickness benefits and to provide an entity to administer L, C; employer to provide injury, life or program. 2. To enable local governments to act as a single entity to provide casualty insurance for their employees and their property for accidental losses. 3. To provide the officers and employees of the local governments with error and omission insurance. 4. To provide bonds for the local government officers. 5. To provide workmen's compensation. 6. To provide unemployment insurance. WHEREAS, the Member desires to obtain from and through the Trust the benefits, insurance or bond below identified. NOW, THEREFORE,T HE TRUST AND THE MEMBER AGREE AS FOLLOWS: 1. The. Trust hereby accepts the Member as a member of the Trust and the Member hereby agrees to the terms and conditions of the Trust as those terms and conditions relate to: a. health, medical and hospital % b. dental l/7 c. casualty l— 7 d. bond l-7 e. unemployment compensation r7 f. professional liability hi g. disability / t h. life insurance X -2- 2. On payment of the premium by the Member to the Trust, the Trust shall provide the insurance or bond set forth in the attached policies the provisions of which are incorporated herein and the policy number or numbers of which are as follows: a. b. c. d. e. f. g• 3. If health, medical and hospital benefits are to be provided, the Member shall forthwith designate a fiscal officer who shall be authorized to pay to the Trust the monthly premium which is as follows: a. Employee without dependents $ b. Employee with one dependent $ c. Employee with two or more dependents $ 4. If dental Lenefits are to be provided, the Member shall forthwith designate a fiscal officer who shall be authorized to pay to the Trust the monthly premium which shall be as follows: a. Employee without dependents $ b. Erriployee with one dependent $ c. Employee with two or more dependents $ 5. If disability insurance is to be provided, the Member shall pay to the Trust the monthly premium of $ per employee. No employee shall be eligible for disability benefits until a£!er he or she has worked 18 months or more at regular full-time employment with the Member. 6. The Member shall provide a of payroll deduction from the salaries of the employees that elect to participate in the plan whereby the employees and the Member's portion of the premium shall be paid by the Member to the Trust. The payment shall be sufficient to fully pay the premium for the employees and the employee's dependents covered by the plan. -3- 7. The Member shall do all things necessary to fully perform the terms and conditions of this Agreement and the policy. 8. The benefits of the policy shall become effective on the /5/1—day of ,S et te,,r,. 6 e,,-- , 197 2 , or on receipt of the first premium, whichever is later. 9. This Agreement shall extend to the/5f44y. (f-5ey,� of the following year from which it is executed. Thereafter this Agreement shall be deemed automatically extended for periods of one year unless notice to termin- ate this Agreement is given in the manner below set forth. 10. Enrollment of the Member's employees shall be made by the Member on forms to be provided by the Trust. 11. Either party may cancel this Agreement by giving at least 30 days written notice prior to of each year of such intent to the other party. 12. The Member understands and agrees that the Trust shall have the right to change benefits and premiums each calendar year provided notice of the changes shall have been mailed to the Member prior to 13. The Trust shall create three categories of group hospital, medical and life insurance as follows: employees. a. Group I shall include all public employers having 50 or fewer b. Group II shall include all public employers having between 51 and 150 employees. c. ' Group III shall include all public employers having more than 150 employees. 14. (a) All members of Group I shall be pooled as one group for the purposes of determining premiums and claims and rating the public employer and establishing the group rate. (b) All members of Group II shall be pooled as one group for the purpose of determining premiums and claims and rating the public employer and establishing the group..rate, but within the Group II, the administrative board may adjust the rates of individual public employers to reflect their good experience or their bad experience. Within this Grote) II there shall be established a reserve to be used exclusively for the benefit of the members of this G roup. Government Trust ADDENDUM This Addendum provides optional coverage and is not part of the foregoing Agreement unless signed by the parties.. In order to provide the Member with a partial month of coverage for its insured employees and their dependents, it is agreed by the parties that coverage shall extend from , 197 to , 197 , on payment by the Member to the Trust the sum of $ Thereafter, full monthly cover- age shall be effective from the date set forth in paragraph eight.
