The Dade County attorney will be defending the suit, and asked if we wish to intervene. Mr. Schulman said that the Village might be drawn into the suit, but in the meantime his office will monitor the suit and inform the council. The Council declined to intervene. On motion of Mr. Printup, seconded by Mrs. Antiles and voted the meeting was adjourned at 12:15 P.M. Attest: Village Clerk January 31, 1984 COUNCIL MINUTES February 28, 1984 The Council of Bal Harbour Village at 9:30 A.M. in the Village Hall. Present: Mrs. Antiles and Messrs. met Tuesday, February 28, 1984 Laikin, Printup, Sherman and Taplin Also present were Fred Maley, Village Manager; Mary Wetterer, Village Clerk, and Alan Gold, Village Attorney. On motion of Mrs. Antiles, seconded by Mr. Printup and voted the minutes of January 31, 1984 were approved as submitted. Mr. Sherman said that the council had agreed that during the past month the plans for the Public Works facility would be reviewed by an outside architectural firm and that the council would consider any remarks Mr. Whitman cared to make regarding an alternate site for the building. Mr. Whitman told the council that he had met with his engineers, H. J. Ross Associates, Mr. Garrett Sloan; and two representatives from the Dade County Department of Environmental Resources Management on February 16, 1984. He gave the council copies of a memorandum of the items discussed and the resulting comments. Mr. Whitman said that these comments show that the Bal Harbour water tank could be removed from the present location on Village property. (Mr. Sherman left the meeting at this time.) Mr. Denham of H. J. Ross explained the items discussed at the meeting. He said they feel the tank is unreliable and could be removed so that the new building could be placed on its location. Mr. Maley and Mr. Wheldon, Superintendent of Public Works disputed the comment regarding the water pumps being out of service. Mr. Sherman returned to the meeting and advised that six months ago Mr. Sloan had advised the village not to remove the tank. He said he had just tried to reach Mr. Sloan for a clarification of his position, but he was not in the city. Discussion followed on use of the tank for February 28, 1984 for water supply under emergency conditions, expenses incurred by the village in order to pass the County fire flow requirements, different plans for the location of the proposed building and future costs of in- stalling booster pumps if the tank is removed. Mr. Desharnais, Building Inspector, explained the bids he has obtained for the modified building. It was moved by Mr. Printup, seconded by Mrs. Antiles and voted to accept the bid from American Steel Systems in the amount of $74,300 for the steel structure, subject to approval of the building plans by Mr. John Haynes, architect. Mr. Maley was also authorized to proceed with contracts for the building and the installation of piles and grade beams. Mr. Sherman said he would clear up the matter of the water tank with Mr. Sloan. Mr. William O'Leary, landscape architect, discussed the final plans for the bus shelters and street furniture on Collins Avenue and 96th Street. He said he had met with Mr. Wheldon regarding removing some trees to allow for the shelters. Mr. O'Leary explained that due to the size of the shelters, space could be provided for either six or three newspaper racks. Mr. Gold told the council that if there are additional racks needed that they must go outside the shelter to comply with our ordinance. The council approved the samples of material to be used for the shelters and furniture. It was moved by Mr. Taplin, seconded by Mr. Laikin and voted that firm prices be obtained and an order be placed with Urban Systems Streetscape, Inc. for the street furniture and bus shelters. The council discussed the signs that will be suppltelto the apart- ment buildings on the west side of Collins Avenue. Mr. Maley stated that when we have a definite price he would notify the buildings to pick out the letter style they prefer. Mr. Maley explained that modifications to allow for the new bus shelters will necessitate removing some bus benches, but that the village will try to provide temporary benches if possible. He said that the area will have the appearance of being under construction for a period of time. The Council discussed the traffic and pedestrian hazzards resulting from the bus stops on 96th Street east of Saks Fifth Avenue. Mr. Maley said he had contacted David Plummer and Associates and has a price of $900.00 for a preliminary report which includes their location of utilities, contacting the Department of Transportation, Dade County Transportation and the location of the bus bay site. An additional fee will be re- quired for complete construction plans. It was moved by Mr. Laikin, seconded by Mrs. Antiles and voted to have the initial study done. Mr. Sherman and the council discussed the Fashion Gala to be held on April 12th. The Mayor said he expected Governor Graham and his wife to attend. Mr. Sherman said he had discussed with Mr. Maley the fees of our engineers, Ludovici and Orange, for the work on the proposed Public Works facility. He said he believes the $56,000 fee to be excessive and asked Mr. Maley to ascertain portal to portal charges and would they be willing to coordinate the work on the building for the fees already charged. Since that time the Engineers have submitted a letter of resignation stating that perhaps the new council would like to choose their own en- gineering firm. Mr. Maley explained that Ludovici and Orange had been February 28, 1984 retained by the village under the Competitive Negotiations Act and although the fees amounted to 9.9% which would be high, they included many items such as the architects's fee for the building, artists rend- erings, soil testing, aerial photographs of the site, landscape architect fees and working with the contractor to reduce the project cost. The actual engineering fees were within reason. Their fees in the past have been favorable to the village and have saved us money. To readvertise and hire a new firm will take two to three months. After further dis- cussion it was moved by Mr. Printup, seconded by Mr. Taplin and voted that Mr. Maley should go back to Ludovici and Orange and see if they will continue as Engineers for the Village;(1) On motion of Mr. Taplin, seconded by Mrs. Antiles and voted the meeting was adjourned at 11:45 A.M. (1) on the basis of a different fee schedule for the completion of the Public Works Facility. Any engineering £t0 f r future work that would exceed $2000 be approved in advance. ,(77 Attest: Village Clerk February 28, 1984 Naygr COUNCIL MINUTES March 27, 1984 A meeting of the Bal Harbour Village Council was held on Tuesday, March 27, 1984, at 9: 30 A.M. Present: Mrs. Antiles, and Messrs, Laikin, Printup, Sherman and Taplin Also present were Fred Maley, Village Manager; Alan Gold, Village Attorney and Betty Carver, Deputy Village Clerk. The minutes of the meeting of February 28, 1984 were approved as amended to reflect that Mr. Maley should contact Ludovici and Orange, Village Engineers to see if they would be willing to remain as village engineers on the basis of a different fee schedule for the completion of the Public Works Facility. Any engineering fees for future works that would exceed $2000 be approved in advance. The amendment was moved by Mr. Printup, seconded by Mrs. Antiles and voted. George Desharnais, Building Inspector, reported that the contracts for the public works building had been signed for the piling, grade beams, and the steel structure. The steel structure will take 6-8 weeks to fabri- cate. The Building Department is contracting with respective sub -contractors. It was moved by Mr. Taplin, seconded by Mr. Laikin, and voted that Ludovici & Orange, Consulting Engineers, and Mr. John Haynes, architect, be re- tained to oversee the construction as required.
