AN ORDINANCE OF THE CITYOF JEFFERSON,MISSOURI, RELINQUISHING ACERTAIN
EASEMENT FOR GENERAL UTILITY PURPOSES IN LOT E OF SOUTHGATE
SUBDIVISION SECTION TWO.
WHEREAS, by an easement recorded in Plat Book 11, Page 803, of the Records of the
Cole County, Missouri, a general utility easement was granted to the City of
Jefferson, a Municipal Corporation, to excavate within, install, construct,
maintain and repair structures for the routing and conveyance of utilities in,
under and through the lots, tracts or parcels of land described in Section 1.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described easement is surplus property
of the City and is no longer needed for any public purpose:
Part of the 20 foot general utility easement as platted along the northerly side
Lot E of Southgate Subdivision, Section Two, in the City of Jefferson, County
of Cole, Missouri, as per plat of record in Plat Book 11, page 803; Cole
County Recorder's Office, more particularly described as follows:
From the northwesterly corner of said LOT E;thence N8401301"E, along the
northerly line of said Lot E, also being the northerly line of said 20 foot
General Utility Easement, 123.79 feet; thence S5°46'59"E, 16.90 feet to the
point of beginning for this description; thence S89 025'34"E, 28.03 feet to the
southerly line of said 20.00 foot General Utility Easement; thence
S840 13'01"W, along the southerly line of said 20 foot General Utility
Easement, 28.20 feet;thence N0 032'20"E, 3.12 fee to the point of beginning.
Containing 44 Square Feet.
Section 2. The easement described in Section 1 is hereby relinquished, and the City
does hereby release and abandon whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to execute any necessary
legal document relinquishing all of the City's interest in the tract of ground described in
Section 1.
Section 4. Ordinance 14461, which was enacted by the City Council of the City of
Jefferson on January 20, 2009, is hereby rescinded.
Section 5. This Ordinance shall be in full force and effect from and after the date of
its passage and approval.
