CITY OF MEDINA
RESOLUTION NO. 96-19
RESOLUTION GRANTING FINAL APPROVAL FOR A LOT
LINE REARRANGEMENT FOR ROBERT MITCHELL AND
CLAIR NADEAU
WHEREAS, Robert Mitchell ("Mitchell") is the fee owner of property located west of
Willow Drive and north of Deer Hill Road, which land is legally described on Exhibit A attached
hereto (the "Mitchell Property"); and
WHEREAS, Clair Nadeau ("Nadeau") is the fee owner of property on Deer Hill Road
west of the Mitchell Property, which land is legally described on Exhibit B attached hereto (the
"Nadeau Property"); and
WHEREAS, Mitchell wishes to purchase from Nadeau and Nadeau wishes to sell to
Mitchell a portion of the Nadeau Property which will be added to the Mitchell Property. The
legal description of the property which is the subject of said transaction (the "Subject Property")
is attached hereto as Exhibit C.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that final approval is hereby granted to Mitchell and Nadeau for the above -described
lot line rearrangement, subject to the following terms and conditions:
1. The Subject Property must be combined with the Mitchell Property and not remain
a separate parcel;
2. No drainage and utility easements will be required around the Mitchell Property
or the Subject Property at the present time, but the city reserves the right to
require same at the time of application for a building permit on the combined
parcel;

3. No building permit will be issued for the combined parcel until it is demonstrated
that the property will comply with all ordinance requirements, including the
existence of acceptable primary and secondary septic sites; and
4. Mitchell and Nadeau shall pay to the city an administrative fee in an amount equal
to the actual cost to the city of reviewing this matter.

The motion for the adoption of the foregoing resolution was duly seconded by member John
Ferris and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Jim Johnson, Thies, Phil Zietlow, and Mayor Anne Theis.
and the following voted against same: None .
Whereupon said resolution was declared duly passed and adopted.

The South half of the Northwest quarter of the Southeast quarter, and the North 50 feet
of the Southwest quarter of the Southeast quarter of the Southeast quarter, all in
Section 21, Township 118 North, Range 23 West of the 5th Principal Meridian,
Hennepin County, Minnesota.

That part of the Southwest'/4 of the Southeast % of section 21 Township 118 North
Range 23 West of the 5th Principal Meridian, lying East of the West 470 feet of said
