HomeMy Public PortalAbout14-8848 Burton & Associates for Additional Services Sponsored by: City Manager RESOLUTION NO. 14-8848 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH BURTON & ASSOCIATES FOR ADDITIONAL SERVICES, IN AN AMOUNT NOT TO EXCEED EIGHT THOUSAND DOLLARS ($8,000.00), FOR ADDITIONAL WATER, SEWER, AND STORMWATER RATES STUDY, A BUDGETED ITEM, PAYABLE FROM ACCOUNT NUMBER 61-513312; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Opa-locka entered into an agreement with Burton & Associates in June 2013 to perform Water, Sewer, and Storm Water rate studies; and WHEREAS, the City was not able to move forward at the completion of the updated Water, Sewer, and Storm Water studies analysis in November 2013; and WHEREAS, the City of Opa-locka is prepared to move forward with the studies now that additional financial data is available; and WHEREAS, the City Commission of the City of Opa-locka desires to authorize the City Manager to enter into an agreement with Burton and Associates, for additional services for the Water and Sewer Rates Study at a cost of$5,000.00, and additional Stormwater Rate Study, at a cost of$3,000.00, with the total amount not to exceed $8,000.00. NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. The City Commission of the City of Opa-locka, authorizes the City Manager to enter into an agreement with Burton & Associates for additional services, in an amount not to exceed Eight Thousand Dollars ($8,000.00), for additional Water, Sewer, and Stormwater Rates Study, a budgeted item, payable from Account Number 61-513312. The City was not ready to move forward until April 2014; however, by that time several major events occurred which resulted in a need to update the original rate analysis: • The FY 2013 ended and the audit report was substantially completed. • More than one-half of FY 2014 was completed and actual financial data was available. • The City was in the receipt of a$40million SRF loan and an $8.5 million loan to build a new City Hall. • The Infrastructure Master Plan was completed. Burton& associates could not reasonably present a rate study that would commit the City to rates over multiple years using outdated data, particularly after significant events had occurred. An updated analysis was required. Financial Impact: No more than $8,000. Implementation Timeline: Immediately Legislative History: Resolution 13-8625 Recommendation(s): Staff recommends approval. Analysis: Burton & Associates has updated the rate studies and presented the results at a Town Hall Meeting on July 23, 2014. The ordinance to update the rates will be presented to the City Commission in September 2014 with the first rate adjustment expected to occur on January 1, 2015. SCOPE OF SERVICES Based upon our discussion, the additional services would include the following fundamental tasks: 1) Complete update to the fund balances, revenue and expenditure data, multi-year capital improvement program, customer and demand data, and all assumptions within the financial forecasting model used in the Analysis in order to reflect the most current data available. Since the Analysis was first initialized, the City has completed its Master Plan Study, developed its Proposed FY 2015 Budget, and completed FY 2013 as well as a substantial portion of FY 2014. As such, it is imperative to update the Analysis to reflect the most current condition and financial requirements of the system. 2) Meet with City staff in an interactive worksession to review the updated results and identify a new multi-year financial management plan for the utility system. 3) Prepare an updated presentation of the results of the Analysis and present the updated results to the City Commission in a workshop as well as at a public hearing. 4) Update to the initial draft report for the Analysis to reflect the revised results. COST OF ADDITIONAL SERVICES As the exact nature/scope of the additional services required and corresponding level of effort is difficult to predict at this time, we propose to provide our services based upon actual time spent and the hourly rates presented in the following table for an amount not to exceed $5,000. 1 believe this type of arrangement will allow for the utmost flexibility to address the requirements of the enterprise fund while being as efficient as possible with its limited resources. This makes it essential that the Water, Sewer, and Stormwater Rates Study be performed as soon as possible; and WHEREAS, the City Commission of the City of Opa-locka recently adjusted the water and sewer rates to FY 2012 rates with the intention of getting a Rate study done; and WHEREAS, the net assets of the Stormwater Fund have continuously declined on a yearly basis, and it is necessary to ensure that the rates are sufficient to maintain the activities of the Stormwater fund; and WHEREAS,this proposal is for an update to the Water and Sewer Study Rate performed in 2007, as opposed to a new study; and WHEREAS, Burton and Associates is the firm that was contracted for the study in 2007, pursuant to Resolution 07-7088 and 07-7113, and due to that fact, already has the City's information in their database; and Resolution No. 13-8625 WHEREAS, the 2007 Water and Sewer study, cost the City $59,728, but the update of the Water and Sewer Rate Study, including a Stormwater Rate Study, will not exceed a cost of $26,215, since it is an update of the same study by the same company; and WHEREAS, the City Commission of the City of Opa-locks desires to authorize the City Manager to enter into an agreement with Burton and Associates, to update the Water, Sewer, and Stormwater Rates Study, since the information is needed on an urgent basis, and it is not practicable of financially feasible to utilize competitive bidding in awarding this contract. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. I have enclosed a Project Work Plan and Cost Estimate Schedule (Schedule) which presents our proposed work plan and cost to conduct the services, which we are proposing to bill periodically on a lump sum basis reflecting the completion percentage of each task. It is important to note that the Schedule contemplates this study being conducted simultaneous with similar studies for the Water/Sewer and Solid Waste Enterprise Funds. If that were not to occur, then the Schedule attached hereto would require modification.
