CITY OF MEDINA
RESOLUTION NO. 96-23
RESOLUTION DENYING REZONING, COMPREHENSIVE
PLAN AMENDMENT AND PLAT APPROVAL TO HANS
HAGEN HOMES FOR MAPLE HURST SUBDIVISION
WHEREAS, Hans Hagen Homes (the "Applicant") has proposed a residential planned unit
development on property containing approximately 16.5 acres located in the northeast quadrant
of Trunk Highway 12 and County Road 29 (the "Subject Property"); and
WHEREAS, the Subject Property is zoned urban commercial and is designated in the
City's comprehensive plan for urban commercial use; and
WHEREAS, the Applicant's proposal for the Subject Property includes the platting of
individual lots and the construction of up to 42 single family dwellings; and
WHEREAS, in order to accomplish such development, it would be necessary for the City
to approve a rezoning, an amendment to its comprehensive plan and a plat with regarding to the
Subject Property; and
WHEREAS, this matter was reviewed by the planning commission on March 12, 1996
and by the City Council at its meetings on April 2 and 16, and May 7 and 21, 1996.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Medina,
Minnesota makes the following findings of fact with regard to the proposed development on the
Subject Property:
1. The Subject Property is zoned urban commercial and has been so zoned for a
considerable period of time. There is no compelling reason to change the zoning
of the Subject Property.

2. The Subject Property is designated in the City's comprehensive plan for use as
urban commercial. The comprehensive plan designation was reviewed as recently
as 1992 when the City adopted its latest comprehensive plan. There is no
compelling reason to change the designation of the Subject Property in the City's
comprehensive plan.
3. The proposed subdivision of the Subject Property into lots for single family
dwellings presupposes that the Subject Property has been rezoned and the City's
comprehensive plan amended. Failure of the project to win support for those land
use approvals renders further consideration of the plat moot.
BE IT FURTHER RESOLVED BY ,the City Council of the City of Medina, Minnesota
that, based on the above findings of fact, the city council denies the Applicant's request for a
rezoning and comprehensive plan amendment for the Subject Property. The Council further
denies approval of the plat for the Subject Property.

The motion for the adoption of the foregoing resolution was duly seconded by member
John Ferris and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Thies, Zietlow, and Mayor Anne Theis.
and the following voted against same: None.
Absent: Johnson
Whereupon said resolution was declared duly passed and adopted.
