HomeMy Public PortalAbout20090126 - Conservation Commission - Meeting Minutes Conservation Commission Meeting 26 January 2009 Page 1 of 2 MINUTES- 26 January 2009 Called to Order: 7:30 PM Hopkinton Town Hall, Room 216 Adjourned: 8:30 PM Members Present: Robert Murphy, Jeffrey Barnes, Michael Carmody, David Teitelman, Ellen Chagnon: Conservation Scientist, Don MacAdam: Conservation Administrator Members Absent: Andre Griben, Craig Nation, Marcus Waldron 7:30 PM Commission Business • The Commission signed the following documents: - Pearson/CAB Realty Trust, 154 East Main St. – Order of Conditions (188-1427) - Moore, 88 Pine Island Rd. – Order of Conditions (188-1428) - LePage, 112 East Main St. – Enforcement and Restoration Order • Mr. Carmody made a motion to approve the Request for Payment dated 26 January 2009. The motion was seconded by Mr. Barnes and it passed unanimously. • Mr. Barnes made a motion to approve the Minutes of 15 December 2008. The motion was seconded by Mr. Carmody and it passed unanimously. • Mr. Barnes made a motion to approve the Minutes of 12 January 2009. The motion was seconded by Mr. Carmody and it passed unanimously. • A discussion was held regarding the proposed restoration plan submitted by Weston Nurseries, 93 East Main Street. The Commission determined that a site inspection by the Conservation Scientist shall be conducted when the season allows and that the Enforcement and Restoration Order issued following the inspection. • Mr. Carmody made a motion to have Ms. Chagnon provide comments to the Planning Board on the Site Plan Review Application for Metrowest YMCA, 45 East Street. The motion was seconded by Mr. Barnes and it passed unanimously. 7:45 PM Deiana, 206 Wood Street DEP File No. 188-1429 Notice of Intent Daniel McIntyre, M.E.S.S., Inc.; Jeff Deiana, applicant/owner Mr. McIntyre presented a proposed plan to abandon a failed cesspool and install a Title V septic system. Ms. Chagnon stated that, due to the snow pack, she was unable to confirm the wetland boundary. The Commission determined that the new septic system will be beneficial to the resource area by improving discharge water quality. Mr. Murphy stated that if the Commission Conservation Commission Meeting 26 January 2009 Page 2 of 2 approves issuing an Order of Conditions then the Order should be conditioned to identify that the wetland delineation has not been approved by the Commission. Mr. Carmody made a motion to close the hearing and issue an Order of Conditions with the standard and noted special conditions. The motion was seconded by Mr. Teitelman and it passed unanimously. 8:00 PM American Climbers, 8 Lumber Street Violation Discussion Nobody representing American Climbers attended the hearing. The Commission determined to require that American Climbers submit a revised plan showing a permanent, immovable barrier located a minimum of ten feet from the wetland edge. 8:05 PM Commission Business • A discussion was held comparing the MACC Model Bylaw with the Hopkinton Wetland Protection Bylaw. Mr. Barnes will prepare a draft of an amended Bylaw in preparation for the May Town Meeting. • Mr. Teitelman made a motion to allow the Hopkinton DPW and any other future applicants to use a U.S. Post Office Certificate of Mailing as proof for notification to abutters for the submittal of a permit application under the Bylaw. The motion was seconded by Mr. Carmody and it passed unanimously. • A discussion was held regarding the after-the-fact filing of a Request for Determination of Applicability by West, 7 and 9 School Street. The Commission determined that, due to the fact that the current snow cover makes preparation of an adequate site plan (identifying the existing conditions, any proposed site work and the area of disturbance) difficult, the deadline for a filing submission will be extended to 01 April 2009.
