CITY OF MEDINA
RESOLUTION NO. 96-30
RESOLUTION GRANTING A SETBACK VARIANCE TO
DAVID SWEEN AND SUSAN SWEEN
WHEREAS, David Sween and Susan Sween (the "Applicants") are the owners of property
located at 2112 Holy Name Drive (the 'Property"); and
WHEREAS, the Property includes a house with an old front porch in poor condition
which the Applicants wish to replace; and
WHEREAS, replacing the front porch in the same general location would require that the
front yard setback be reduced from 50 feet to 26 feet; and
WHEREAS, the city's zoning ordinance requires a variance to grant a reduced setback;
and
WHEREAS, this matter was reviewed by the planning commission at its meeting on June
11, 1996 at which time the planning commission recommended approval of the front yard setback
variance; and
WHEREAS, this matter was reviewed by the city council at its meeting on June 18, 1996.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that the requested front yard setback variance be granted to the Applicants for the
Property, subject to the following conditions:
1. The proposed front porch must be constructed in substantial compliance with the
plans and specifications submitted to and approved by the city;
2. The proposed front porch must be replaced within one year of the date of this
resolution or an extension of said time must be granted by the city council prior
to its expiration. If neither occurs, the approval hereby granted shall be null and
void thereafter; and

3. The Applicants must pay to the city an administrative fee in the amount necessary
to reimburse the city for its costs in reviewing this application.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of
Medina, Minnesota that the above described variance is justified because of the shape of the
Property and the location of the house on the Property pose a hardship in complying with the
setback requirement.

The motion for the adoption of the foregoing resolution was duly seconded by member Ann
Thies and upon vote being taken thereon, the following voted in favor thereof:
Zietlow, Thies, John Ferris, James Johnson, and Mayor Anne Theis.
and the following voted against same: none
Whereupon said resolution was declared duly passed and adopted.
