HomeMy Public PortalAbout1996-033Member John Ferris introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 96-33 RESOLUTION GRANTING FRONT YARD AND REAR YARD VARIANCES TO THOMAS WOLFF AND ANN RIEFF WHEREAS, Thomas Wolff and Ann Rieff (the "Applicants") are the owners of property located at 4624 Brook Street (the "Property"); and WHEREAS, the house on the Property was constructed with the intention of adding a deck to the west side in the future; and WHEREAS, the Applicants now wish to construct a deck 24 feet in length and 12 feet in width to complete the house on the Property; and WHEREAS, to do so would require a reduction in front yard setback from 30 feet to 22 feet and a reduction in rear yard setback from 30 feet to 15.15 feet; and WHEREAS, the city's zoning ordinance requires variances under such circumstances; and WHEREAS, this matter was reviewed by the planning commission at its meeting on July 9, 1996 at which time the planning commission recommended approval of the variances; and WHEREAS, the city council reviewed this matter on July 16, 1996. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the requested variances be granted to the Applicants, subject to the following terms and conditions: 1. The proposed deck must be built in substantial compliance with the plans and specifications submitted to and approved by the city; 2. The proposed deck must be built within one year of the date of this resolution or an extension of said time must be granted by the city council prior to its uHB107511 ME230-8 expiration. If neither occurs, the approval hereby granted shall be null and void thereafter; and 3. The Applicants must pay to the city an administrative fee in an amount equal to the city's cost in reviewing this application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that the variances are justified by the hardship of the size and shape of the lot and the fact that the variances are similar to those granted for the house.
