RESOLUTION NO. 96-34
JTION VACATING DRAINAGE AND UTILITY
ENT FOR GALL M. KNAPPENBERGER AND SHARYN

WHEREAS, Gail M. Knappenberger and Sharyn W Knappenberger (the "Applicants") are
the fee owners of property legally described as Lot 2, Block 1, Leed's Maple Ridge, according
to the plat thereof on file in the office of the Registrar of Titles for Hennepin County, Minnesota;
and
WHEREAS, the Applicants wish to vacate a portion of the 10-foot drainage and utility
easement along the perimeter of their property; and
WHEREAS, the Applicants are replatting their property in connection with adjacent land
owned by their neighbors so that the easement proposed to be vacated will no longer be along
the perimeter of a lot; and
WHEREAS, the city council has reviewed this matter and is of the opinion that, following
replatting of the property, the easement will no longer be necessary; and
WHEREAS, a public hearing was held on this matter by the city council on July 16, 1996,
following notice as required by Minnesota Statutes, section 412.851.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The easement described on Exhibit A attached hereto is hereby vacated;
2. The city clerk -treasurer shall prepare a notice of completion of these proceedings
and shall submit same to the Hennepin County auditor for entry upon the records
of the county;

this easement vacation.

The motion for the adoption of the foregoing resolution was duly seconded by member
John Ferris and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Johnson, Mayor Theis, and Thies
and the following voted against same:
None

Whereupon said resolution was declared duly passed and adopted.
