CITY OF MEDINA
RESOLUTION NO.96-36
RESOLUTION GRANTING PRELIMINARY APPROVAL FOR
THE PLAT OF FOXBERRY FARMS 3RD ADDITION
WHEREAS, Wallace Doerr and Lundgren Bros. Construction Co. (collectively, the
"Applicants") have previously platted property known as Foxberry Farms and Foxberry Farms
2nd Addition; and
WHEREAS, the Applicants now propose to replat Lot 4, Block 4, Foxberry Farms and
Lot 3, Block 4, Foxberry Farms 2nd Addition along with property legally described on Exhibit
A attached hereto; and
WHEREAS, the property shall be divided into four parcels and shall be known as
Foxberry Farms 3rd Addition; and
WHEREAS, this matter was reviewed by the planning commission at its meeting on June
11, 1996; and
WHEREAS, this matter was reviewed by the city council at its meeting on July 2, 1996.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that preliminary approval is hereby granted to the Applicants for the captioned matter,
subject to the following terms and conditions:
1. The Applicants and the City must enter into a development agreement essentially
similar to those previously entered into by the parties regarding Foxberry Farms
and Foxberry Farms 2nd Addition;
2. All driveways for the new properties must be in locations approved by the public
works director;

3. The existing driveway for the property on County Road 116 owned by Wallace
Doerr must be removed no later than 24 months after final approval of the plat of
Foxberry Farms 3rd Addition or 30 days after the home is vacated or removed,
whichever occurs first;
4. The Applicants must comply with the requirements of the city engineer as outlined
in his letter dated May 28, 1996 to Loren Kohnen;
5. The Applicants must submit adequate title evidence for review by the city
attorney;
6. The Applicants must pay to the City an administrative fee in an amount
determined to represent the cost of reviewing this application; and
7. The Applicants must submit the final plat for review to the City within 180 days
through the date of this resolution or request an extension thereof prior to the
expiration of said period.

The motion for the adoption of the foregoing resolution was duly seconded by member
Jim Johnson
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Johnson, Thies, AND Zietlow
and the following voted against same:
None
Absent: Mayor Theis
Whereupon said resolution was declared duly passed and adopted.
