CITY OF MEDINA
RESOLUTION NO. 96-37
RESOLUTION VACATING DRAINAGE AND UTILITY
EASEMENTS FOR LUNDGREN BROS. CONSTRUCTION CO.
AND WALLACE DOERR
WHEREAS, Lundgren Bros. Construction Co. and Wallace Doerr (collectively, the
"Applicants") are the fee owners of property legally described on Exhibit A attached hereto (the
"Subject Property"); and
WHEREAS, the Applicants are in the process of platting the Subject Property as Foxberry
Farms 3rd Addition; and
WHEREAS, pursuant to the plat, the Applicants wish to vacate all of the drainage and
utility easements currently existing on the previously platted portions of the Subject Property; and
WHEREAS, a public hearing was held before the city council on this matter on August
6, 1996, following notice as required by Minnesota Statutes, section 412.851.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. All drainage and utility easements on the previously platted portions of the Subject
Property are hereby vacated;
2. The city clerk -treasurer is authorized and directed to prepare a notice of
completion of these proceedings and to submit the same to the Hennepin county
auditor for entry upon the records of the county; and
3. The city staff is authorized and directed to take any and all additional steps
necessary to accomplish this easement vacation.

The motion for the adoption of the foregoing resolution was duly seconded by member
Jim Johnson and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Johnson, Thies, and Zietlow
and the following voted against same:
None
Absent: Mayor Theis
Whereupon said resolution was declared duly passed and adopted.
