HomeMy Public PortalAbout1996-038Member Jim Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.96-38 RESOLUTION GRANTING VARIANCE TO THERESA NAAB AND PETER NAAB WHEREAS, Theresa Naab and Peter Naab (the "Applicants") are the owners of property located at 2785 Morningside Road (the "Subject Property"); and WHEREAS, the Applicants wish to expand the garage on the house on the Subject Property and reduce the front yard setback from 30 feet to 19 feet; and WHEREAS, in order to construct the garage addition 19 feet from the front lot, it is necessary for the city to grant a front yard setback variance; and WHEREAS, this matter was reviewed by the planning commission at its meeting on August 13, 1996 and by the city council at its meeting on August 20, 1996. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a variance be granted to the Applicants to reduce the front yard setback for a garage addition at the Subject Property from 30 feet to 19 feet, subject to the following terms and conditions: 1. The garage addition must be constructed in accordance with the plans and specifications submitted to and approved by the city; 2. The Applicants must pay to the city an administrative fee in the amount necessary to reimburse the city for its costs in reviewing this applications; and 3. This variance shall be valid from one year from the date of this resolution. If construction of the project is not started within said period by issuance of a building permit and initiation of construction, the approval hereby granted shall be null and void. R1113109007 ME230-8 NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that the variance hereby granted is justified by the following hardships: 1. The setback of the addition would be consistent with the setback of the existing house; and 2.
