CITY OF MEDINA
RESOLUTION NO.96-39
RESOLUTION GRANTING FINAL APPROVAL TO DONALD
LAURENT FOR SOUTH CREEK ADDITION
WHEREAS, Donald Laurent (the "Applicant") has requested permission to plat property
containing approximately 70.55 acres into five parcels; and
WHEREAS, this matter was reviewed and preliminarily approved by the planning
commission and city council; and
WHEREAS, the Applicant has requested final plat approval, which final plat has been
reviewed in accordance with the city's ordinances and for its conformance with the terms and
conditions of preliminary plat approval.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that final plat approval is granted to the Applicant for South Creek Addition, subject
to the following terms and conditions:
1. The Applicant must grant to the City a 10 foot easement for trail purposes over
Lots 1 through 4, Block 1;
2. The plat must be in compliance with the requirements of the Elm Creek Watershed
District;
3. The Applicant must inform those who acquire title to Lots 1 through 4, Block 1,
that the following conditions apply:
a. Basement elevations of the houses to be constructed on said lots must be
a minimum of 4'/2 feet above the elevation of the sewer invert;
b. The location of the driveways on said parcels must be approved by city
staff prior to issuance of a building permit;

c. There exists only 3 water services for the 4 lots. One lot will require
construction of a new water service from the water main on the north side
of Hamel Road. The city will require a permit for said service and it must
be installed in accordance with city requirements; and
d. The city will collect sewer and water charges at the time building permits
are issued for houses on these parcels;
4. The Applicant must pay park dedication fees on Lots 1 through 4, Block 1 in the
amounts determined by the city assessor;
5. The Applicant must pay an administrative fee to the city in the amount determined
by the city to represent its actual cost for reviewing this application; and
6. The final plat must be filed with Hennepin county within 60 days of the date of
this resolution. Thereafter, the approval hereby granted shall be null and void and
of no further force or effect.

The motion for the adoption of the foregoing resolution was duly seconded by member
Phil Zietlow and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Johnson, Thies, and Zietlow
and the following voted against same:
None
Absent: Theis
Whereupon said resolution was declared duly passed and adopted.
