RESOLUTION NO. 14 -8868
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA- LOCKA, FLORIDA, TO ESTABLISH AN
ADMINISTRATIVE FEE IN THE AMOUNT OF $100.00
PER PETITIONERS' APPEAL REQUEST FOR THE CITY
OF OPA -LOCKA RED LIGHT CAMERA HEARING AS
PROVIDED BY THE FLORIDA STATUTES; PROVIDING
FOR INCORPORATION OF RECITALS; PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, Florida Legislature House Bill 7125, was signed into law on June
13, 2014; and
WHEREAS, H,S. Bill 7125 amends the Mark Wandall Traffic Safety Act, which
requires local municipalities to administer an appeals process for recipients with Red
Light Camera violations; and
WHEREAS, the City recommends a $100.00 administrative fee (per appeal
request) for the Red Light Camera violation, in addition to any fine associated with the
notice of violation (NOV); and
WHEREAS, the process will be as follows: a) if petitioner is Found Guilty —
petitioner pays $100.00 + NOV fee; b) if petitioner Cancels the requested hearing 5 days
in advance — petitioner pays $50.00 + NOV fee; c) if petitioner Pleads Guilty at the
beginning of the requested hearing — petitioner pays $75.00 + NOV fee.; and d) if
petitioner is a No Show at the hearing — petitioner pays $100 administrative fee + NOV
fee.

NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa -locka hereby authorizes
and directs the City Manager to establish an administrative fee in the amount of $100.00
per petitioners' appeal request for the City Of Opa -locka Red Light Camera hearing as
provided by the Florida Statutes.
Section 3. This resolution shall take effect immediately upon adoption.

Staff Summary:
On May 2, 2013, the Florida Legislature passed House Bill 7125 and was signed into law on June 13,
2013. This bill amended the Mark Wandall Traffic Safety Act to require local municipalities to administer
an appeals process for recipients of a Notice of Violation (NOV) in conjunction with the City's Red Light
Camera Program. The City is recommending a red light camera administrative fee of $100.00 which is
the same administrative fee for other city code violations.
