Mayor ProTem Yu called the Regular City Council meeting to order at 7 :33p.m. 2. ROLL CALL PRESENT: ABSENT : ALSO PRESENT: Councilmember-Fish , Man , Sternqu ist , Yu Councilmember-Chavez City Manager Cook, City Attorney Vail , City Clerk Kuo , Community Development Director Forbes , and Administrative Services Director Hause Councilmember Fish made a motion to excuse Mayor Chavez for cause . Seconded by Councilmember Sternquist. 3. INVOCATION Pastor Walden from First Baptist Temple City provided the Invocation . 4. PLEDGE OF ALLEGIANCE Boy Scout Troop #174 provided a flag ce remony and le d those present in the Pledge of Allegiance . 5. CEREMONIAL/PRESENTATIONS A. INTRODUCTION OF AUSTRALIAN EXCHANGE STUDENTS Mitzi Franco and Jenny Vicario , representing the Sister City organization , introduced the exchange students from Australia. Brooke Gibson, Amy Fradd , Alyssa Micallef, Fergus Ryan , Amy Anne Schultz, and Tom Smithers . City Council Minutes September 15, 2015 Page 2 of 10 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jerry Jambazian, Temple City business owner, congratulated City Manager Cook on his one year work anniversary . Carl Blum , Temple City resident , shared his co ncern about private drones on priva te property. He urged City Council to adopt an Ordinance banning use of private drones in the City . Steve Stafford , Temple City resident , expressed concern regarding the intermediate care facilities for the developmentally disabled near Cloverly Elementary School. 7. CONSENT CALENDAR Staff pulled Consent Calendar Item 7F to amend the recommendation . Councilmember Sternquist made a motion to approve the remainder items on the consent calendar. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS - MEETING OF AUGUST 26, 2015 The City Council is requested to review the Transportation and Public Safety Commission actions of their meeting of August 26 , 2015 . Action : Received and filed . D. SECOND READING AND ADOPTION OF ORDINANCE NO . 15-1005 ADDING CHAPTER 8 TO TITLE 7 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO SMALL RESIDENTIAL ROOFTOP SOLAR ENERGY SYSTEMS Adoption of Ordinance No . 15-1005 will bring the City into compliance with AB 2188 and promote the installation of small residenti al rooftop solar energy systems . Action: Adopted Ordinance No . 15-1005. E. LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE RESOLUTIONS The City Council is requested to receive and file the League of California Cities (League) annual resolutions and approve the voting delegate and voting alternate to use their discretion to vote on the proposed resolutions . Action : 1) Received and filed League of California Cities Annual Conference Resolutions ; and 2) Approved the voting delegate and voting alternate to use th eir discretion to vote on the proposed resolutions . G . PETTY CASH AND VISA CARD REPORT The City Council is requested to review , receive and file the Petty Cash and Visa Card Report . Action : Re ceived and filed report . H. ADOPTION OF RESOLUTION NO . 15-5122 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No . 15-5122 authorizing City Council Minutes September 15 , 2015 Page 4 of 10 the payment of bills . Action : Adopted Re solution No . 15-5122 . Consent Calendar Item 7F was heard out of agenda order. F . APPROVAL OF MEMORANDUM OF UNDERSTANDING (MOU ) BETWEEN THE COUNTY OF LOS ANGELES , THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT , AND THE CITIES OF ALHAMBRA, MONTEBELLO , MONTEREY PARK , PASADENA , ROSEMEAD , SAN GABRIEL , SAN MARINO , SOUTH EL MONTE , SOUTH PASADENA , AND TEMPLE CITY REGARDING THE ADMINISTRATION AND COST SHARING AMONG THE PARTIES RELATED TO THE LOAD REDUCTION STRATEGY FOR THE RIO HONDO RIVER AND TRIBUTARIES As the City moves forward with implementation of the new Municipa l Separate Storm Sewer System (MS4) permit , the City faces significant costs to meet the new Total Maximum Daily Load (TMDL) requirements . This MOU is a means to reducing these costs. City Manager Cook amended staffs recommendation to inc lude an appropriation of $9 ,000 from Undesignated Fund Balance towards the payment of the MOU. Councilmember Man made a motion to approve a MOU between the County of Los Angeles , the Los Angeles County Flood Control District, and the c ities of Alhambra , Montebello , Monterey Pa rk , Pasadena , Rosemead , San Gabriel , San Marino , South El Monte , South Pasadena , and Temple C ity regard ing the administration and cost sha ring among the part ies related to the Load Reduction Strategy (LRS) for the Rio Hondo Rive r and tributaries ; approve an appropriation of $9,000 from the Undesignated Fund balance towards the payment of the MOU ; and authorize the City Manager to sign the MOU . NEW BUSINESS A FIRST READING AND INTRODUCTION OF ORDINANCE NO . 15-1006 , AN ORDINANCE AMENDING CHAPTER 5 .5 "BUDGET RESERVE FUND BALANCE REQUIREMENTS " OF TITLE 2 "ADMINISTRATION " OF THE TEMPLE CITY MUNICIPAL CODE In order to meet the City Council 's objective of maintain i ng budgeted reserves for fund balances , it is recommended the City Council adopt the proposed Ordinance. Administrative Services Director Hause gave a summary of the staff report. Mayor Pro Tem Yu opened public co mment. Hearing no request to speak , Mayor ProTem Yu closed public comment. Councilmember Man made a motion to introduce Ordinance No . 15-1006 for first reading by title only ; waive further reading of Ordinance No . 15-1 006 ; and schedule the second reading of Ordinance No . 15-1006 for October 6 , 2015 . TRAFFIC CALMING MEASURES FOR ENCINITA AVENUE BETWEEN LAS TUNAS DRIVE AND BROADWAY The recommended traffic calming measures shou ld serve to slow traffic along Encinita Avenue and make drivers more aware of the speed limit and signalized intersections . Community Development Director Forbes gave a summary of the staff report . City Council commented and discussed regarding the traffic ca lming measures proposed for Encinita Avenue between Las Tunas Drive and Broadway. Mayor ProTem Yu opened public comme nt. Steve Stafford , Temple City resid en t , com mented regarding th e traffic calmi ng measures proposed by staff. Councilmember Fish made a motion to approve the implementation of traffic calming measures on Encinita Avenue between Las Tunas Drive and Broadway, as recommended in the memo dated April 3 , 2015 from the City's contract traffic consultant (Transtech); approve the installation of decorative elements in conjunction with the traffic calming measures ; and appropriate $11 ,000 from the General Fund Undesignated Fund Balance to be transfe rred to Account No . 21 -960-74-4255 (State Gas Tax Fund ) Traffic Signs & Striping Maintenance , Striping/Pavement to fund the recommended traffic calming measures and decorative elements. City Manager Cook announced that latest issue of Connect Magazine is now available; provided an update on the effect of the rainstorm on the City ; and shared that staff has been attending trainings provided by the Joint Power of Insuran ce Authority . 13. The ad hoc will be bringing a recommendation for City Council consideration shortly. Mayor Pro Tern Yu also commented on the Pavement Management Plan and would like staff to bring back a strategy on funding mechanism to implement the Pavement Management Plan . K . She shared the impact the drought is having on the farm s and the agricultural community and how this will have an influence on the price of produce. B .
