CITY OF MEDINA
RESOLUTION NO. 97-01
RESOLUTION GRANTING VARIANCE TO JOHN POLKER
AMERICAN LEGION POST NO. 394
WHEREAS, John Polker American Legion Post No. 394 (the "Applicant") is the fee owner of
the property located at 75 Hamel Road (the "Subject Property"); and
WHEREAS, the Applicant wishes to construct a covered entry over the front steps on the
building on the Subject Property; and
WHEREAS, the covered entry would extend to within 9' 8" of the front yard line of the
Subject Property; and
WHEREAS, the city zoning ordinance requires that all structures maintain a 50-foot front yard
setback under such circumstances; and
WHEREAS, this matter was reviewed by the planning commission at its meeting of December
10, 1996 and by the city council at its meeting of December 17, 1996.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that a
variance be granted to the Applicant to reduce the front yard setback from 50 feet to 9' 8", for a
covered entry at the Subject Property, subject to the following terms and conditions:
1. The covered entry must be constructed in accordance with the plans and specifications
submitted to and approved by the city;
2. The Applicant must pay to the city an administrative fee in an amount necessary to
reimburse the city for its costs in reviewing this application; and
3. This variance shall be valid for one year from the date of this resolution. If
construction of the covered entry is not started within said period of time by issuance
of a building permit and initiation of actual construction, the approval hereby granted
shall thereafter be null and void.

BE IT FURTHER RESOLVED by the city council of the city of Medina that compliance with
the city's zoning ordinance regarding the front yard setback would cause a hardship in this instance due
to the location of the existing building on the Subject Property. It is further the view of the city council
that no harm will be done in granting the variance because other properties in the area have similar
front yard setbacks and the covered entry will not have an adverse affect on public health or safety.

The motion for the adoption of the foregoing resolution was duly seconded by member Thies and upon
vote being taken thereon, the following voted in favor thereof
Ferris, Hamilton, Thies, and Zietlow
and the following voted against same: None Absent: Johnson
Whereupon said resolution was declared duly passed and adopted.
