CALL TO ORDER CITY COUNCIL TEMPLE CITY, CALIFORNIA REGULAR MEETING OCTOBER 6 , 2015 AGENDA ITEM ?.A-2 Mayor Chavez called the Regular City Council meeting to order at 7 :30 p.m . 2. Seconded by Mayor Pro Tern Yu . 3. INVOCATION Pastor Darrel Kelty , Community of Christ , provided the Invocation . 4. PLEDGE OF ALLEGIANCE Boy Scout Troop #174 provided a flag ceremony and led those present in the Pledge of Allegiance . 5. CEREMONIAL/PRESENTATIONS A. PET OF THE MONTH D ia ne and Charlie Ri os , San Gabriel Humane Society volunteers , introduced the featured pet for the month "Norma Jean ", a 1 year old female Chihuahua and Dachshund Mix . Those interested in adopting her can call the San Gabriel Valley Humane Society at (626) 286-1159. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Lynne Best , Historical Society , invited the public to the Historical Society Museum 's upcoming spec ial events i n October. Ousama Nimri , T emp le City resident , commented on street flooding throughout the city when it ra ins . 7 . SECOND READING AND ADOPTION OF ORDINANCE NO . 15-1006 AMENDING CHAPTER 5 .5 "BUDGET RESERVE FUND BALANCE REQUIREMENTS" OF TITLE 2 "ADMINISTRATION " OF THE TEMPLE CITY MUNICIPAL CODE Adoption of Ord i nan ce No . 15-1 006 will accurately reflect the purpose of the reserves for Emergencies/Disasters , Liquidity and Local Economic Uncerta i nty . Action : Adopted Ordinance No . 15-1006. E . APPROVAL OF PERMITS FOR USE OF THE LOS ANGELES COUNTY PARKING LOT , LOCATED AT 5939 GOLDEN WEST AVENUE , FOR THE 2015 FALL FESTIVAL AND THE 2016 CAMELLIA FESTIVAL City Council approval is required for comp letion of the permit process for use of the parking lot , adjacent to the Los Angeles County Public Library for both the City 's 2015 Fall Festival and the 2016 Camellia Festival. Action : Approved the permits for use of the Los Angeles County Library parking lot for both the 2015 Fall Festival and the 2016 Camellia Festival and authorize staff to execute. F . FINAL SUBDIVISION MAP APPROVAL FOR PARCEL MAP NO. 73046 , A THREE-UNIT CONDOMINIUM SUBDIVISION AT 9703 GARIBALDI AVENUE Certifying the final map will allow the developer to record said map and start construction of the project. Action : 1) Received the Subdivision Impro vement Agreement ; 2) Approved the final subdivision map for Parce l Map No . 73046 ; 3) Authorized the City Manager to execute the Subdivision Improvement Agreement; and 4 ) Authorized the City Clerk to certify Parcel Map No . 73046 . APPROVAL OF FIRST AME NDMENT TO AGREEMENT WITH PLANNING CENTER I DC & E TO PROVIDE ADDITION AL SERVICES RELATED TO THE GENERAL PLAN UPDATE , ZONING CODE UPDATE, A ND THE PREPARATION OF A SPEC IFIC PLAN Amendment to th e contract is necessary to ensure the consultant has funds to comp lete approved tasks a nd to fully vet drafts with the community before bringing f inal drafts to the C it y Co un cil for approva l. Action : H . PETTY CASH REPORT Approved the first amendment to th e Consultant Services Agreement with the Planning Center 1 DC & E in the amount of $162,300. The City Council is requested to review , receive and file the Petty Cash Report . Action : Received and filed report . I. A UDIT REPORT FO R SOUTH COAST AI R QUALITY MANAGEMENT DISTR ICT (SCAQMD) FOR FISCAL YEAR (FY) 201 1-12 The audit f or t he SCAQMD Special Revenue Fund is required to be conducted at least once every two years . Action : Received and filed the FY 2011-12 SCAQMD Audit Report . J . ADOPTI O N OF RESOLUTIO N NO . 15-5124 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No . 15-5124 authorizing the payment of bil ls . Action : Adopted Resolution No . 15-5124. 8. PUBLIC HEARING A. FIRST READING AND INTRODUCTION OF ORDINANCE NO . 15 -1007 AMENDI NG CHAPTER 4 , ARTICLE D OF THE TEMPLE CITY MUNICIPAL CODE RELATIVE TO TREE PRESERVATION AND PROTECTION Ordinance N o . 15-1007 amends two sections of Chapter 4 , Article D . TREE PRESERVATION AND PROTECTION of the T emple City Munici pal Code. City Council Minutes October 6 , 2015 Page 5 of 9 The proposed amendments include additional cr iteria for removal of City owned trees. Parks and Recreation Directo r Burro ughs gave a brief summary of the staff report. City Co un cil a sked staff questio ns about the proposed Tree Preservation and Protectio n Ordinance . Mayor C havez opened public hearing . Steve Staffo rd , Temp le City res id e nt , comme nted on homeowners purchasing insurance to hold the city harm less if they want to keep a non-city planted trees on pub l ic right away . Franklin Ruedel , Temple City resident , commented about an agenda item from a previous City Council meeting relating to trees . Mayor Pro T em Yu made a motion to introduce amended Ordinance No . 15-1007 (removal of second paragraph in 3-4D-6 ) for first read i ng by title only ; waive further reading of Ordinance No . 15-1 007 ; and schedu le the second reading of Ordinance No . 15-1007 for October 20 , 2015. SCHOOL SAFETY UPDATE-None City Council M i nutes October 6 , 2015 Page 6 of 9 City Manager Cook reported on the flooding caused by the rain yesterday and shared that staff is working with the county to prepare for upcoming El Nino . City Manager Cook also reported on the street improvements throughout the City (i.e . street slurry). Lastly , auditors will be auditing City's finances for the next three weeks . City Manager Cook announced upcoming Fall Festival on Oct. 17 from 12-4 p .m . in the Temple City Park . 13. UPDATE FROM CITY ATTORNEY A. NEW DRONE LEGISLATION City Attorney Va i l provi ded an overview on the law and federal regulations pertaining to unmanned aircraft systems (i.e . d rone ). SCHOOL DISTRICT/CITY STANDING COMMITIEE (Mayor Chavez and Councilmember Fish )-Formed 1/3/2012 Mayor Chavez reported on the standing committee 's meeting on September 29 . The standing committee received an update on the school bond and construction , discussed pedestrian traffic and safety around the schools , received information on Rose Parade Grant opportunity , and proposed future joint meeting in February between the City Council and School Board members .
