(i.e., if term limits is extended, incumbents would be eligible to serve for those extended
period if re-elected).
In 1992, a measure was proposed to the voters of Temple City to limit City Council
terms to two-four year terms. The measure passed with 1771 (77%) votes for the
measure and 540 (23%) votes against the measure. In 1998, a measure was proposed
to the voters of Temple City to amend City Council terms to three -four year terms.
The measure failed with 1488 (62%) votes against the measure and 927 (38%) votes
for the measure. In 2001, a measure was proposed to the voters of Temple City to
rescind City Council term limits. The measure failed with 2450 (75%) votes against the
measure and 842 (25%) votes for the measure. According to Government Code
Section 36502, the measure requires a majority of the votes cast to pass.
Provided in Attachment "A" is a survey conducted by City of Thousand Oaks in 2011
showing cities that impose term limits and their terms. The survey includes information
that was updated by staff in 2014. In the state of California, there are 120 Charter
cities and 361 General Law cities. According to the survey, 43% of all Charter cities
impose Council term limits, while only 13% of General Law cities imposed Council term
limits. Of the 101 cities (Charter and General Law combined) that impose a term limit,
65% (66) of the cities have a two-four year term limit, 16% (16 cities) of the cities have a
three-four year term limit, 3% (3 cities) of the cities have a two-two year term limit, while
the other (16%) 16 cities have varied term limits.
Provided in Attachment "B" is an estimate of cost from Los Angeles County Registrar if
City Council should decide to move forward and add one measure to the next Statewide
General Election on November 8, 2016. Included in Attachment "B" are the deadlines in
which the City must submit required documents to start the process (i.e., due April,
2016: Resolutions calling election for ballot measure; Resolution requesting for
consolidation with County election; Resolution authorizing Council to write
arguments/City Attorney to write impartial analysis; and Resolution allowing rebuttal
arguments.)
City Council is requested to provide direction as to whether staff should take actions
necessary to provide a measure on the November 8, 2016, Statewide General Election
regarding City Councilmember term limits and what the specifics of the limitations
should be.
CITY STRATEGIC GOALS:
A review of Section 502 (C) of the City's Charter pertaining to City Council term limit
provision promotes the City's Strategic Goal of Good Governance.
