CITY COUNCIL
MINUTES
FEBRUARY 15, 1983
INITIATION:
CALL TO ORDER:
Mayor Tyrell called the regular meeting of the City Council to order
at 7:32 p.m. on Tuesday, February 15, 1983, in the Council Chamber of
the City Hall.
2. The invocation was given by Dr. Ed Linberg, Temple City Christian Church,
9723 Garibaldi
3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell.

5. CONSENT CALENDAR:
Councilman Atkins moved to approve Items A through H on the Consent
Calendar as recommended, seconded by Councilman Gillanders and carried.
A. APPROVAL OF MINUTES: Regular Meeting of February 1, 1983.
Approved as corrected.

B. RECOMMENDATION FROM TRAFFIC COMMISSION - Meeting of February 2,
1983. CROSSING GUARD FOR GIDLEY SCHOOL, LOWER AZUSA ROAD AND
ARDEN DRIVE.
Approved placing a crossing guard for Gidley School at the intersection
of Lower Azusa Road and Arden Drive, appropriated an additional sum in
the amount of $2,112 and amended the adopted budget accordingly.
C. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION - Special Meeting
of February 7, 1983: LIVE OAK PARK IMPROVEMENTS.
Approved the recommendations from the Parks & Recreation Commission for
the improvements of Live Oak Park as set forth in staff memo of February
8, 1983, and authorized staff to instruct the architect to proceed with
necessary concept, drawings and related plans and specifications to accom-
plish the improvements.
D. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of February 8, 1983,
(1) PROPERTY NUISANCE CASE NO. 32 -76: VACANT LOT -6241 GOLDEN WEST
AVENUE.
Adopted Resolution No. 83 -2142 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC
NUISANCE AND ORDERING ABATEMENT THEREOF.
(2) REQUEST FOR CLARIFICATION OF AMBIGUITY - VIDEO COMPUTER STORE
AS A PERMITED USE. IN THE C- 1 /C -1 -R ZONES,
Approved a clarification of ambiguity determining that the retail sales
of computers and video equipment be a permitted use in the C- 1 /C -1 -R
Zones, and requested the Planning Commission to initiate an amendment
to the Temple City Zoning Code to permit the retail sales of computers
and video equipment in the C- 1 /C -1 -R Zones.

(3) PLANNING COMMISSION ACTION - Meeting of February 8, 1983.
Received and filed memo from Planning Commission relating to action
taken at their regular meeting held February 8, 1983.
E. ACCEPTANCE OF BID - STREET LIGHTING CONVERSION, PHASE III, CAMELLIA
KAUFFMAN AVENUE, PORTIONS OF LAS TUNAS DRIVE.
Accepted low bid of $22,400 from State Construction Division of Union
Metal Manufacturing Co. for street lighting conversion and authorized
Mayor and City Clerk to sign.
F. REQUEST FOR LEAVE OF ABSENCE FOR SHIRLEY RASCHKE, BUSINESS LICENSE
CLERK.
Approved leave of absence for. Business License Clerk.
G. RESOLUTION NO. 83 -2138: EMPLOYMENT OF PERSONNEL
Adopted Resolution No. 83 -2138 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY APPOINTING PERSONNEL.
H. RESOLUTION NO. 83 -2139: WARRANTS AND DEMANDS.
Adopted Resolution No. 83 -2139 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $116,838.01
DEMAND NOS. 5255 THRU 5335.
6. UNFINISHED BUSINESS:
A. PUBLIC HEARING: 7:30 p.m. ANNEXATION NO. LD 83 -1: CITY -WIDE LIGHT-
ING DISTRICT, SANTA ANITA AVENUE, LIVE OAK TO GRAND AVENUE.
City Manager Koski presented background information stating the proposed
annexation to the City -Wide Lighting District is necessary because the
City will be responsible for the maintenance of the street lights to be
installed on Santa Anita Avenue from Live Oak to Grand Avenue. In order
for the City to assess all properties which will benefit from this stree
lighting, the properties facing Santa Anita Avenue on the east side of
the street should be annexed to the City -Wide Lighting District, which
includes some areas which are not in any lighting district. City Council
at their regular meeting held February 1, 1983, received and approved the
Engineer's Report, adopted a resolution declaring its intention to annex
the area and fixed Fel,ruary 15, 1983, to hear objections from property
owners or citizens within the proposed annexation area. Public hearing
was noticed in the Temple City Times and posted at 300 foot intervals in
the area to be annexed.
Mayor Tyrell declared the public hearing open and invited anyone wishing
to speak to come forward. There being no one come forward to speak,
Councilman Atkins moved to close public hearing, seconded by Councilman
Gillanders and carried.
Councilman Atkins moved to approve Negative Declaration, seconded by
Councilman Swain and carried.
Councilman Atkins moved to adopt Resolution No. 83 -2140 A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING ANNEXATION NO. LD
83 -1 TO THE CITY -WIDE LIGHTING DISTRICT, seconded by Councilman Gillande-
and carried.
Councilman Atkins moved to adopt Resolution No. 83 -2141 A RESOLUTION OF '
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY WITHDRAWING ALL TERRITORY
LYING WITHIN THE CITY -WIDE LIGHTING DISTRICT FROM THE LOS ANGELES COUNTY
LIGHTING MAINTENANCE DISTRICT NO. 1395 PURSUANT TO THE PROVISIONS OF
SECTION 19290 OF THE STREETS AND HIGHWAY CODE TO THE STATE OF CALIFORNIA,
seconded by Councilman Dennis and carried.

B. PROGRESS PAYMENT: SLURRY SEAL PROJECT:, MAINTENANCE AREA NO. 2 -
D & D ASPHALT.
City Manager Koski presented background information stating that at
Council direction, staff reviewed with the County Road Department all
streets within the slurry seal area, including specific problem areas
mentioned by the City Council. The Los Angeles County. Road Department
after reviewing those problem areas recommended a progress payment for
the work completed, less penalties and expenses incurred in correcting
some of the problems.
Mayor Tyrell stated a condition of payment should be that the contractor
accept the penalties and expenses as enumerated in the Road Department
report when accepting Progress Payment No. 2.
Councilman Atkins moved to approve Progress Payment No. 2 in the sum of
$50,164.71 to D & D Asphalt, after deducting the penalties and expenses
in the sum of $11,341.21 and withholding 10% retention of $10,929.27,
seconded by Councilman Swain and carried.
C. RENEWAL OF AGREEMENT - PERMIT TO CROSS OVER PEDESTRIAN MALL, PUBLIC
PARKING LOT 1A, PARKING DISTRICT 1 - Zager Smith Carpet Co.
City Manager Koski stated that pursuant to Council's instruction, staff
had contacted Mr. Zager and requested his attendance at this evening's
meeting at which time Mr. Zager stated that he would not be able to
attend in that he had decided 'to close his business and expects to
terminate operations around February 20, 1983.
Councilman Gillanders moved to terminate the permit to cross over the
pedestrian mall, seconded by Councilman Atkins and carried.
D. ORDINANCE NO. 83 -533: 2nd reading AMENDING THE TEMPLE CITY ZONING
CODE RELATING TO PERMITTED USES IN THE C -1 ZONE AND CREATING A NEW
LIMITED RESTRICTIVE C -1 -R ZONE.
Councilman Atkins moved to waive further reading'; seconded by Councilman
Swain and carried.
Councilman Dennis moved to adopt Ordinance No. 83 -533 AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING AN AMENDMENT TO
THE ZONING CODE RELATING TO PERMITTED USES IN THE C -1 ZONE AND CREATING
A NEW LIMITED RESTRICTIVE C -1 -R ZONE, seconded by Councilman Swain and
carried on a Roll Call vote.

7. NEW BUSINESS:
None.
8. COMMUNICATIONS:
A. City Manager Koski presented a communication from the Camellia
Festival requesting approval of Junior Statesmen of America along
the parade route on Saturday, February 26.
Councilman Gillanders moved to approve the additional vendor as
recommended by the Camellia Festival, seconded by Councilman
Atkins and carried.
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
John Dosh of D & D Asphalt expressed displeasure that he had not been
inform-JO—nor received a copy of the staff recommendations regarding the
progress payment.

RECESS TO CRA:
At this time, Council recessed to meet as the Community Redevelopment Agency,
all members being present, approved the minutes of the regular meeting of
February 1, 1983, and adopted resolution approving warrants and demands.
The minutes are set forth in full in the records of the Agency.
RECONVENE AS CITY COUNCIL:

There was no action to be taken.
11. MATTERS FROM CITY OFFICIALS:
A. Ordinance Regulating Adult Book Stores
City Attorney Martin introduced Ordinance No. 83 -534 AN ORDINANCE
OF THE CITY OF TEMPLE CITY AMENDING THE MUNICIPAL CODE RELATING
TO THE ZONING AND BUSINESS LICENSES OF ADULT BUSINESSES for first
reading by title only. Councilman. Dennis moved to waive further
reading, seconded by councilman Atkins and carried.
B. Local Restrictions of Solicitations.
Council discussed regulations and expressed concern relating to
children and /or adults soliciting door to door after dark, and
instructed the City Attorney to prepare an appropriate ordinance
delineating the hours soliciting will be permitted and be brought
back for their consideration on the March 1 Agenda.
C. Councilman Atkins directed the Council's attention to the San
Gabriel Valley Association of Cities Dinner Meeting on February
17th, the topic being "The New LAX Airport ".
He also stated that the San Gabriel Valley Association of Cities
took a position opposing SB -18 which declared the Long Beach Free-
way is complete and requested Council direct staff to prepare a
letter to our local representatives opposing SB -18 to go out over
the Mayor's signature.
12. ADJOURNMENT:
On motion by Councilman Swain, seconded by Councilman Dennis, meeting
adjourned at 8:15 p.m. Next regular meeting of the City Council will
be held Tuesday, March 1, 1983,.7:30 p.m. in the Council Chamber of
the City Hall.
