HomeMy Public PortalAbout1997-009Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 97- 9 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO THE SPRING HILL GOLF COURSE WHEREAS, Spring Hill Golf Club (the "Applicant") has requested permission to construct and operate a golf course on a site containing ±210 acres and located in Orono and Medina; and WHEREAS, the portion of the golf course proposed for Medina (±48 acres) is located on property zoned rural residential; and WHEREAS, golf courses are a conditional use within the rural residential zoning district; and WHEREAS, on February 11, 1997, the planning commission reviewed the application and recommended approval thereof, subject to certain conditions; and WHEREAS, the city council reviewed the matter on April 15, 1997 and concluded that the Applicant's proposed use of the property is not likely to adversely affect the development of adjacent property for uses for which it is zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota that a conditional use permit is hereby granted to the Applicant for the construction and operation of a golf course, subject to the following conditions: 1. The project must be approved by the Minnehaha Creek Watershed District; 2. Responses to the issues raised in the Environmental Assessment Worksheet, for which the City of Orono is the responsible governmental unit, must be satisfactory in form and substance to the city; 3. The Applicant must make a contribution to the city's park fund and/or carry out restoration plans on the property consistent with a tree ordinance of city wide application to be adopted prior to April 15, 1999; provided, because the tree ordinance does not presently exist, the contribution shall be subject to a maximum amount mutually acceptable to the Applicant and to the city; 4. The Applicant must dedicate to the city a trail easement on the east side of Tamarack Drive to be consistent with the trail system in Orono; 5. The retaining wall to be constructed on the 9th tee must be acceptable to the city; RHB121222 ME230-252
