CITY OF MEDINA
RESOLUTION NO. 97-14
RESOLUTION GRANTING FINAL PLAT APPROVAL TO
FOXBERRY FARMS 4TH ADDITION
WHEREAS, Wallace Doerr and Lundgren Bros. Construction, Inc. (collectively, the
"Applicants") have requested approval to plat certain property in Medina generally located west of Co.
Rd. 116, north of T.H. 55 and south of Hackamore Road (the 'Property"); and
WHEREAS, portions of the Property have been designated and previously platted as Foxberry
Farms, Foxberry Farms 2nd Addition and Foxberry Farms 3rd Addition; and
WHEREAS, the Applicants have proposed to replat portions of Outlot O, Foxberry Farms
which has been designated as Foxberry Farms 4th Addition; and
WHEREAS, the Applicants have previously received preliminary approval of the plat of
Foxberry Farms 4th Addition and have now requested final approval for said plat; and
WHEREAS, the final plat has been submitted to and reviewed by the city and found to be
consistent with all requirements of preliminary plat approval.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that final approval is hereby granted to the Applicants for the plat of Foxberry Farms 4th
Addition, subject to the following:
1. No lot within the approved plat may be developed with a single family home or
accessory use until Lundgren Bros. Construction, Inc. and the city have executed a
development agreement regarding said lot;
2. The Applicants must file the final plat with Hennepin county within 60 days of the date
of this resolution or the approval granted hereby shall be considered null and void; and
3. The Applicants must pay to the city a fee in an amount sufficient to reimburse the city
for its costs and expenses in reviewing the plat, including the cost of preparing and
negotiating the development agreement.

The motion for the adoption of the foregoing resolution was duly seconded by member Jim Johnson
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Johnson, Thies and Zietlow
and the following voted against same: None Absent: Hamilton
Whereupon said resolution was declared duly passed and adopted.
