HomeMy Public PortalAbout1997-016Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.97-16 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 296 BY TITLE AND SUMMARY WHEREAS, the City Council of the City of Medina has adopted Ordinance No. 296, an ordinance amending sections 820.25, 820.29, 820.49, 820.59, 825.45, 826.15, 826.25, 826.51 and 826.63 of the city's code of ordinances relating to the regulation of individual sewage treatment systems; and WHEREAS, the ordinance is 15 pages in length; and WHEREAS, Minnesota Statutes, § 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that the city clerk -treasurer shall cause the following summary of Ordinance No. 296 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The City Council of the City of Medina has adopted Ordinance No. 296. The ordinance codifies changes in state law regarding individual sewage treatment systems. The distinction currently made in the city's ordinances between conventional (trench) and innovative (mound) systems has been eliminated. Both trench and mound systems are now classified under state law as standard systems. The amendment brings the city's ordinance into compliance with this provision. The amendment also provides that a minimum of five contiguous acres of acceptable soil is necessary for installation of a standard sewage treatment system. Beginning on July 1, 1999, no more two acre lots will be created within the city. Existing two acre lots as of that date will be "grandfathered" under the amended ordinance. Additional changes will be made in the city's Individual Sewage Treatment and Disposal Systems ordinance in the future for purposes of consistency with state law and this ordinance amendment. A copy of the full ordinance is available at city hall ihe city clerk and is available for review during regular business hours.
