SUBJECT: CONSIDERATION OF A WASTE ADJUSTMENT REQUEST FOR WASTE
SERVICES FROM ATHENS SERVICES, INC.
RECOMMENDATION:
The City Council is requested to approve the rate adjustment requ est for waste
collection rates made by Athens Services to become effective July 1, 2015.
BACKGROUND:
1. On February 18 , 2003 , the City Council approved an Amended and Restated
Agreement with Athens Services , the City's contract waste collector.
4 . On May 29 , 2015 , the City was notified by Athens Services , that they have
adjusted the rates for waste services to be effective July 1, 2015 .
ANALYSIS:
Athens Services is requesting City Council approval of a 1.15% single family resident ial
rate increase and 0 .88 % commercial 3-yard b in rate increase for its waste collection
services . Last year, Athens requested a 1 .07 % increase for single family residential and
a 1.22 % i ncrease for commercial. This request is in compliance with the amended
agreement between the City and Athens. Section 8 .2 of the agreement (Ra te Review)
states:
"The Contractor may submit an application for rate review not more often than
annually . The complete application shall be submitted within te n (1 0) days after
(i) the Contracto r receives the annual notice of adjustment in landfill tipping fees
from any disposal site presently being used pursuant to this Agreement and (ii)
the publication of the increase o r decrease in Consumer Price Index (C PI ) for the

previous 12-month period (Ma y through April) for all urban consumers in the Los
Angeles-Anaheim-Riverside area , non -housing , but in no event later than June 1
for the period starting July 1. The City Council will take action on the request as
soon as possible and will complete the approval process by July 1. The
application shall show how the rate increase meets the formula set out in Section
8.4 ."
Section 8.4 (Rate Formula ) states :
"Any rate adjustment pursuant to this Agreement will be calculated as set out in
Exhibit "D" attached and incorporated as if fully set forth herein ."
Pursuant to Section 8 .2 of the amended agreement, Athens subm itted a rate
adjustment request on May 29 , 2015 (Attachment "A"). The submittal met the time
requirements of Section 8 .2 of the Amended Agreement.
The rate adjustment request is broken into 3 components : 1) Collection &
Transportation , 2) Process , and 3) Disposal. These 3 components add up to what is
called the "Net Rate ", or the portion that goes to Athens . The proposed rate also
includes a 5% City Franchi se Fee and a 2 % Solid Waste Management Fee . The "Net
Rate " plus the two City fees constitute the "Gross Rate ", or total rate to the
customer. "Single Fam i ly Residential " is the only service category that does not include
the franchise fee .
Components 1 & 2 are adjusted every July 1 based on the CPI change from April to
April , or 0.47 % for this adjustment. Component 3 is adjusted by the percent change in
the Athens Material Recovery Facility (MRF) from J uly to July , or 3 .51 % for this
adjustment. The two tables below summarize the proposed rate adjustment.

Attached are the rate adjustments for 2015 (Attachment "B") and existing rates effective
July 1, 2014 (Attachment "C"), which outline in detail the proposed rate adjustments for
Temple C ity cus tomers . The new rates would be effective starting July 1, 2015.
CONCLUSION:
The City Counci l is requ e sted to approve the rate adjustment request by Athens
Services , per the provisions of their agreement. The new rates would be effective July
1 , 2015 . The new sing le-fam ily rate wou ld i ncrease from $31.73 to $32 .10 per month , a
1 .15% increase from the previous year. The rate for a three cub ic yard commercial bin
would increase from $190 .73 to $192.43 , a 0.88 % increase from the previous yea r.
FISCAL IMPACT:
The rate increase wi ll affect residentia l and commercial trash service and will have no
impact to the Fiscal Year (FY) 2015-16 City Budget.

In accordance with our agreement with the C ity of Temple City, we have adjusted the rates for
waste serv ices, as referenced in the attach ed Exhibit, to be effective July 1, 2015.
The operati ons component of the rates is based on the percent age change in the Consumer Price
Ind ex from Apri l 20 14 to April 20 15 of .47%. The rubbish component is based on the
percentage change in the Athens MRF from J uly 2014 to July 2015 of3.51 %.
Please handle the administrative processing of this request to make the rates effectiv.e July 1,
