HomeMy Public PortalAbout1997-021J Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.97-21 RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO RANDALL MAYER WHEREAS, Randall Mayer, d/b/a Mayer Mobile (the "Applicant") is the owner of property located at 762 T.H. 55 in Medina (the "Subject Property"); and WHEREAS, on August 15, 1995, the Applicant received a conditional use permit from the city for construction of an automotive service station/convenient store on the Subject Property; and WHEREAS, the Applicant now wishes to amend the conditional use permit to allow the construction of a car wash on the Subject Property; and WHEREAS, construction of a car wash on the Subject Property requires a conditional use permit; and WHEREAS, this matter was reviewed by the city council at its meeting on June 3, 1997; and WHEREAS, the city council has determined that the proposed car wash will not impair the orderly development of adjacent properties for purposes for which they are zoned. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Medina Minnesota that an amended conditional use permit is granted to the Applicant for construction of a car wash on the Subject Property, subject to the following terms and conditions: 1. The car wash must be a recycling type and built in accordance with the plans and specifications submitted by the Applicant to the city; 2. If the water discharge from the car wash surpasses an average of 750 gallons per acre per day, the Applicant must modify the hours of operation or the number of washes to ensure that criteria is met and that the total annual discharge of water from the car wash does not exceed 500,960 gallons; 3. Parking spaces 14, 15 and 16, as labeled on the site plan submitted by the Applicant, must be moved to the south side of the building and parking area; 4. Exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or right-of- way; 5. The Applicant must pay three additional sewer availability charge (SAC) units at $950 RHB124507 ME230-116 each plus a connection fee of $3,004 per SAC unit, which fees must be paid at the time the building permit is issued for the car wash; 6. The Applicant must designate an additional driving lane in accordance with the letter of the city engineer dated April 25, 1997; 7. The Applicant must maintain records regarding the pit equipment for review by the city; and 8. The Applicant must pay to the city an administrative fee in an amount necessary to reimburse the city for its costs in reviewing this application. NOW, THEREFORE, BE IT FURTHER RESOLVED, by the city council of the City of Medina, Minnesota that this resolution is in addition to, and not a substitute for, Resolution No. 95-34 regarding the Applicant's automobile service station and/convenient store on the Subject Property. All conditions of Resolution 95-34 continue to be in full force and effect, except those which are explicitly or by reasonably necessary implication contradicted by terms and conditions of this Resolution.
