RESOLUTION NO. 15 -8916
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA- LOCKA, FLORIDA AUTHORIZING
THE EXPENDITURE OF $5,000 FOR A RETAINER
AGREEMENT FOR THE REPRESENTATION OF
COMMISSIONER TERENCE PINDER, FOR OUTSIDE
COUNSEL, IN THE MATTER OF THE UNITED
STATES ENVIRONMENTAL PROTECTION AGENCY
(USEPA) DEBARMENT, PAYABLE FROM ACCOUNT
NUMBER 28- 514390; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, Commissioner Terence Pinder has been duly elected as a commissioner of the
City of Opa -locka to represent the interests of all residents of the City; and
WHEREAS, the United States Environmental Protection Agency (USEPA) has purported
to issue a debarment, affecting the ability of Commissioner Pinder to vote or participate on certain
items involving Federal funds and
WHEREAS, the actions of USEPA are unwarranted and should be disputed by
Commissioner Pinder and the City of Opa- locka.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA- LOCKA, FLORIDA:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa -locka authorizes that a retainer
of $5,000 shall be paid to outside counsel, to be selected by Commissioner Terence Pinder, for
the representation of Commissioner Terence Pinder, in disputing the USEPA debarment, payable
from Account Number 28- 514390.
RESOLUTION NO. 15 -8916
Section 3. Any invoices received by the City in excess of the retainer may be
approved by the City Commission.
Section 4. This resolution shall take effect immediately upon adoption.
