HomeMy Public PortalAbout1997-028Member Ann Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 97-28 RESOLUTION GRANTING A CONDITION USE PERMIT TO SCOTT BAKER WHEREAS, Scott Baker (the "Applicant") is the owner of property legally described on Exhibit A attached hereto (the "Subject Property"); and WHEREAS, the Applicant wishes to construct an office building on the Subject Property, which is zoned urban commercial; and WHEREAS, the city's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter was reviewed by the planning commission at its meeting on June 10, 1997 and by the city council at its meeting on July 1, 1997; and WHEREAS, it has been determined that the use of the Subject Property for the purpose described will not impede the orderly development of adjacent properties for purposes for which they are zoned. NOW, 111LREFORE, BE IT RESOLVED by the city council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purposes, subject to the following terms and conditions: 1. Landscaping size and type must meet ordinance requirements and be maintained. Additional landscaping, including spruce trees eight feet in height and other indigenous plantings, must be made with the approval of the staff for the purpose of screening the single family homes northwest of the site. The berm to be constructed is intended to shield the site's parking area; 2. All exterior lighting on the site must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property; RHB127594 ME230-262 1 97-28 8-5-97 3. Parking lot lights shall not remain on all night, but minimum security lighting may be maintained all night; 4. The exterior dumpster enclosure must be built of concrete, brick or stone; 5. Drainage and erosion control must be accomplished and maintained in accordance with the requirements of the city engineer and watershed district; 6. The Maple Plain fire department must review the plans before a building permit is issued; 7 There shall be no exterior storage on the site; 8. There shall be no outside bells or loudspeakers on the site; 9. Four sewer availability charge (SAC) units, as determined by the Metropolitan Council, and any connection fees must be paid by the Applicant before a building permit will be issued; 10. A letter of credit in the amount determined by the city engineer must be provided before a building permit is issued in order to ensure construction of site improvements; 11. A water meter must be provided to monitor sewer flows from the site; 12. The parking area and driveway must be constructed to the standards required by the city engineer; 13. If any space within the facility is leased, an administrative conditional use permit will be required for occupancy by the tenant; 14. The developer may install and maintain a gated entrance to the site, with the approval and cooperation of the police and fire departments; 15. The Applicant shall join in a cooperative effort for a stop sign at the entrance to County Road 29; and 16. The Applicant must pay to the city an administrative fee in an amount necessary to reimburse the city for its expenses in reviewing this application.
