BOARD OF HEALTH MEETING B (�E(iSiER �� ,?h� CLERK JANUARY 3 , 2018 AT 7 : OOPM TOWN HALL, ROOM B Board members present: Carmen Scherzo, DVM, Chairman; Joe Ford, Vice Chairman; Mary Chaffee, RN, PhD, JD and Annette Graczewski, (ASCP) Others present: Nancy Ellis Ice, CHO, RS, MPH, Health Director 1 . Chairman's announcements Happy New Year. Dr. Scherzo read an announcement from the Barnstable County Regional Emergency Planning Committee stated that there would be no pre- storm opening of regional storm shelters. They will provide updates tomorrow. The VNA in conjunction with the Board of Health will hold a Child and Adolescent Immunization and Lead Screening clinic on Monday January 151h from 941AM at the VNA office at 434 Route 134 Dennis. Appointments are required and residents can call 508 - 957 - 7423 . The current administration in Washington has denied George Heufelder's 319 non- profit source grant application. This is the first time in 21 years he has not gotten a grant. He will re- apply next year. Dr. Scherzo recognized Penny Holeman, a Brewster resident that has been attending the last few Board meetings . She has offered to volunteer her time in the Health Department if needed. 2 . Sweetser Engineering - Local variance request for 103 Pine View Drive Mrs. Graczewski recused herself and left the room. Terry Hayes presented this to the Board. This is an existing home which needs the septic system replaced but has a well and wetlands on the lot. There is a very limited area to put the new system in. They are requesting the following variance : 1 . To allow the SAS to be 72 feet from the wetland Mr. Ford asked about Conservation Commission approval. Mr. Hayes stated that they already have an Order of Conditions . Dr. Chaffee asked about the depth to groundwater and the groundwater flow. Mr. Hayes stated it was in excess of 7 feet. Mrs. Ice stated that groundwater flow is Southeast, which is away from the pond. Dr. Scherzo asked about the flood zone. Mr. Hayes stated it was not in the flood zone. Motion : Finding that this is a tight lot and the only place the new system could go, approve the variance request to keep the SAS 72 ' from the wetland. Motion : Joe Ford Second : Mary Chaffee Vote : 4- 0 - 0 Action : Motion carried Dr. Chaffee pointed out a portion of the letter from Sweetser that stated "to not approve the variance request would be a manifest injustice as the property is currently under agreement and would deny the owners the ability to sell and render it WWW.BREWSTER-MA. " Dr. Chaffee does not believe that the statement is a fair interpretation of what the definition of "manifest injustice " is when the Board considers whether to approve a variance or not. The way this statement reads is an inaccurate representation. 3 . J .M . O'Reilly & Associates Inc. - Local variance request for 114 Canoe Pond Drive Matt Farrell presented this to the Board. This is an existing 3 bedroom dwelling. A septic inspection was done and found the system in good working order with the exception of a few minor repairs that needed to be done. They are requesting the following variance : 1 . To allow the SAS to be approximately 143 feet from Canoe Pond Groundwater is to the East, away from the pond. Groundwater separation is approximately 21 feet. Dr. Chaffee asked what the minor repairs were. Mr. Farrell stated that the outlet tee and d-box needed to be replaced and a cover needed to be raised. Motion : Finding that the groundwater flow is away from the pond and groundwater separation is approximately 21 feet, approve the variance request to allow the SAS to remain approximately 143 feet from Canoe Pond. Motion : Joe Ford Second : Annette Graczewski Vote : 4- 0 - 0 Action : Motion carried 4. J.M . O' Reilly & Associates Inc. - Local variance request for 43 North Pond Drive Matt Farrell presented this to the Board . This is an existing 4 bedroom dwelling. A septic inspection was done and found it in good working order with the exception of the SAS being only 161 feet away from the pond . Groundwater flow is North" Northwest and there is a 19 foot separation from groundwater. The system was installed in 1993 . A variance of 139 feet is being requested. Dr. Scherzo stated that the septic system is in the groundwater capture area of the pond and is concerned with this . He is not in favor of granting a variance for this . Mrs. Graczewski asked about the test pits that had previously been done and if they had looked at them for possibly putting a new system in those location. Mr. Farrell stated that they had not. There was a discussion on the results of the peres that were done in 1993 . Mrs . Ice stated that at the time of the inspection the pit was noted as being dry. Mrs. Graczewski believes that putting in a new system would be very costly because of all the sand that would have to be removed . Dr. Scherzo mentioned requiring an I/A system to be installed. Mrs . Ice stated that there are no phosphorus I /A systems that are approved for general use and that it would add more cost to a new system. Motion : Finding that the groundwater separation is 19 feet, the groundwater flow is going in a Northwest direction and according to the septic inspection the pit was dry and in good working order, approve the requested 139 foot variance. Motion : Joe Ford Second : Annette Graczewski Vote : 341 0 Action : Motion carried 5 . Ryder & Wilcox - Title 5 and Local variance requests for 162 Owl Pond Road Stephanie Sequin presented this to the Board. This is a 39,000 square foot lot with a 4 bedroom home that abuts Owl Pond , The home was built in 1990 . In 2016 a septic inspection was done as the home was put up for sale. The system was noted as BOH 1 /3 / 18 Minutes Page 3 being in good working order with the exception of the SAS being too close to Owl Pond and a few minor repairs needed to be done. There was also a question about the number of bedrooms in the home. The homeowner applied for a variance at that time and the Board met and stated that if there was actually 4 bedrooms there, a new septic system would have to be installed. Eventually it was decided to continue the application indefinitely. They are now going to install a new 4 bedroom septic system, The following variances are requested . 1 . To allow the proposed SAS to be 167 feet from Owl Pond 2 . To allow the proposed SAS to be greater than 3 feet below finished grade Groundwater is flowing away from the pond and there is a 25 foot separation from the bottom of the pit to groundwater. There would be a vent and components will be H2O. Motion : Finding that groundwater is flowing away from the pond, there is a 25 foot separation from bottom of pit to groundwater, there will be a vent and H2O components, approve the variance request for the proposed SAS to be 167' from Owl Pond and for the proposed SAS to be greater than 3 feet below finished grade .
