CALL TO ORDER: Mayor Tyrell called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, April 19, 1983, in the Council Chamber of the City Hall. 2. The invocation was given by Reverend Doug Beyer, First Baptist Church of Temple City, 6019 North Baldwin. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL: Present: Absent: Also Present: Councilmen- Atkins, Dennis, Gillanders, Swain, Tyrell Councilmen -None City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Planning Director Shaw, Parks and Recreation Director Kobett, Julie Estrada, Temple City Times and David Gero, the Pacesetter, PRESENTATION: Mayor Tyrell stated it was his pleasure to make a presen- tation to one of our past members as the Outstanding Older American. Lou Merritt has generously given of his time over the past 30 years helping to make Temple City a better place to live. He served 22 years on the City Council with four terms as Mayor. Some of his many other contribu- tions included his associations with the Kiwanis Club, March of Dimes, Co- ordinating Council, Temple City Junior Rifle Club and Boy Scout Counselor. Mr. Merritt thanked the Council for their recognition and added he missed the associations with the people he has had over the past years. PROCLAMATION: Mayor Tyrell presented the Quota Club of Temple City with a Proclamation formally proclaiming May 8 through May 14 as Shatter Silence Week. Quota International is a nonprofit, service organization of executive business and professional women. Since 1974 they have provided community service to those with hearing and speech handicaps. Monira Ward, President, thanked Mayor Tyrell and members of the Council and stated that supporting their organization is helping those suffering with a hearing or speech handicap. She added their organization will be sponsoring a "Hearing Awareness Fair" on May 14 and will provide free hear- ing tests for all ages. 5. REORGANIZATION OF COUNCIL : A. At this time, the City Clerk assumed the Chair and opened nomi- nations for the office of Mayor for the coming year. B. Councilman Swain nominated Councilman Gillanders for the office of Mayor, seconded by Councilman Atkins. Mayor Tyrell moved that nominations be closed and a unanimous ballot cast for Councilman Gillanders for the office of Mayor, seconded by Councilman Atkins and carried. C. Mayor Gillanders assumed the Chair and thanked the members of the Council for giving him the opportunity to serve and asked for their support and guidance in the coming year. Councilman Atkins nominated Councilman Swain for the office of Mayor Pro Tem, seconded by Councilman Dennis. Councilman Tyrell moved that nominations be closed and that a unanimous ballot be cast for Councilman Swain, seconded by Councilman Dennis and carried. Council Minutes, April 19., 1983 - Page 2 D. Appointments: Mayor Gillanders made the following committee appointments, following which it was moved by Councilman Atkins, seconded by Councilman Tyrell and unanimously carried that the appointments be confirmed. Dennis 1 1 Councilman Atkins moved to adopt Resolution No. 83 -2153 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING AN ALTERNATE DIRECTOR OF COUNTY SANITATION DISTRICT NO. 15, seconded by Councilman Tyrell and unanimously carried. Presentation: On behalf of the City Council, Mayor Gillanders presented a plaque to Councilman Tyrell in appreciation of the outstanding leader- ship he has provided, and as a small token for all the things he has accomplished. In particular, it was noted that Councilman Tyrell has devoted a great deal of time in representing the City in connection with negotiations with the County. 6. CONSENT CALENDAR: • Councilman Tyrell requested that Item 6. G be removed from the Consent Calendar. On motion by Councilman Tyrell and seconded by Councilman Swain all other items onthe Consent Calendar were unanimously approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of April 5, 1983 Approved as written. Council Minutes, April 19, 1983 - Page 3 B. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION - Meeting of April 5, 1983. LIVE OAK PARK IMPROVEMENTS Approved preliminary working drawings and scope of improvements for Live Oak Park as prepared and submitted by Recreation Systems, and authorized said firm to proceed with preparation of the final plans and specifications and necessary bid documents. C. PLANNING COMMISSION ACTION: Meeting of April 12, 1983 Received and filed memo relating to action by the Planning Commission at their regular meeting held April 12, 1983. D. PROPOSAL BY SOUTHERN CALIFORNIA EDISON COMPANY - REMOVAL OF LIVE TREES - VARIOUS LOCATIONS Approved Negative Declaration and authorized Edison Company to remove 12 Palm trees and replant with trees as specified per staff memo of April 13, 1983. E. REQUEST FOR AUTHORIZATION TO RECRUIT FOR SUMMER RECREATION STAFF Authorized staff to recruit the necessary personnel to conduct the seven week Summer Recreation Program. F. AGREEMENT FOR COMMUNITY RECREATION PROGRAM WITH TEMPLE CITY UNIFIED SCHOOL DISTRICT Approved Community Recreation Agreement with Temple City Unified School and authorized Mayor and City Clerk to sign. H. RESOLUTION NO. 83 -2154: WARRANTS AND DEMANDS Adopted Resolution No. 83- 2154 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $231,035.46 DEMAND NOS. 5547 THRU 5631. CONSENT CALENDAR ITEM C. APPLICATIONS FOR FIREWORKS STANDS L. 1983 Councilmembers expressed concern that in the past years late appli- cations had posed a problem and City Council wanted to go on record noting the March 31 deadline. Councilman Tyrell moved that the March 31 deadline for applications submitted for Fireworks Stands will be strictly adhered to with ab- solutely no exceptions, seconded by Councilman Dennis and unanimously carried. 7. UNFINISHED BUSINESS: A. PUBLIC HEARING: 7:30 p.m. EXTENSION OF INTERIM ORDINANCE NO. 83 -534 RELATING TO THE ZONING OF ADULT BUSINESSES City Manager Koski presented background information stating that City Council at their regular meeting of March 1, 1983, adopted an urgency Ordinance relating to the zoning of adult businesses. This interim Ordinance expires before the proposed Ordinance will take. effect. Public hearing was set for this evening for the purpose of extending this interim Ordinance until the new Ordinance would become effective. Mayor Gillanders declared the public hearing open aid invited anyone wishing to speak to come forward. There being no one come forward to speak, Councilman Atkins moved to close public hearing, seconded by Councilman Tyrell and unanimously carried. Councilman Tyrell moved to adopt Ordinance No. 83 -536 AN ORDINANCE OF THE CITY OF TEMPLE CITY EXTENDING INTERIM ORDINANCE NO. 83 -534, seconded by Councilman Swain and unanimously carried. PUBLIC HEARING: 7:30 p.m. PROPOSED AMENDMENT TO THE ZONING CODE RELATING TO THE ZONING OF ADULT BUSINESSES City Manager Koski presented background information stating that the Planning Commission on March 22, 1983, approved and recommended to the City Council an ordinance amendment relating to the zoning of adult businesses. This amendment revises the definitions of "adult business" and "sexually oriented" as it pertains to the ordinance; specifies locations where adult businesses are permissible and pro- vides that if certain of the provisions are found by the courts to be invalid, then such uses shall automatically be classified as a con ditional use requiring a permit pursuant to the Zoning Code. Public hearing was set for this evening for 1st reading of the Ordinance. Mayor Gillanders declared the public hearing open and invited anyone wishing to speak to come forward to speak, Councilman Tyrell moved to close public hearing, seconded by Councilman Atkins and unanimously carried. Councilman Tyrell moved to approve Negative Declaration, seconded by Councilman Atkins and unanimously carried. Councilman Dennis moved to adopt Ordinance No. 83 -537 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING PART XIV -A OF THE ZONING CODE RELATING TO THE ZONING OF ADULT BUSINESSES for 1st reading by title only, seconded by Councilman Swain and unani- mously carried. 8. NEW BUSINESS: A. APPEAL OF TRAFFIC COMMISSION DENIAL - OVERNIGHT PARKING PERMIT Bill Agajanian, 5522 North Alessandro Avenue City Manager Koski presented a summary background stating the appli- cant's first request for two permits was denied because there was sufficient off - street parking available on the premises. The appli- cant re- applied listing an additional vehicle, a Chevrolet Truck, which was denied on the basis that the truck was overweight and over - width. Applicant appealed to the City Council. Bill Agajanian, 5522 North Alessandro, stated that all he would need at this time is a temporary three week parking permit which is the estimated time for his son's escrow to close. The permit would be for the Ranchero. Although there are sufficient spaces for his vehicles, he felt it did disturb his neighbors by starting up the cars at 3 a.m. when he returned from work. Councilman Dennis stated that he agreed with the Traffic Commission denial based on the facts they had; however, since the facts have changed and it is only a temporary permit, he would be in favor of granting his appeal. Councilman Atkins opposed granting the appeal on the basis of incon- venience only, since there were sufficient spaces for his vehicles, Councilman Dennis moved to grant a temporary parking permit, for three weeks through May 8, seconded by Councilman Tyrell and carried on a roll call vote. Councilmembers received and filed the evaluation report regarding this year's Camellia Festival. I10. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. RECESS TO CRA: RECONVENE AS CITY COUNCIL: 11. ACTION ON REQUEST BY CRA: There was no action to be taken. 12. MATTERS FROM CITY OFFICIALS: A. LEAGUE OF CALIFORNIA CITIES - LEGISLATION RE: GAS TAX REVENUES AB -1599 Council Minutes, April 19, 1983 - Rage 5 B. DRAINAGE PROBLEM - NORTH° SIDE OF " FREER STREET Council received petition from residents in the proximity of Freer Street who were concerned about the drainage problem on the north side of Freer Street. Councilman Atkins moved to refer the Petition to staff for a report detailing the nature of the problem and refer back to City Council at their May 3 meeting, seconded by councilman Tyrell and unanimously carried. 1 1 City Manager Koski presented a memo from the League of California Cities regarding AB -1599, a measure which would allow the State Department of Housing Community Development, rather than local city councils, to dictate the contents of local housing elements by with- holding gas tax revenues, or portions thereof, if the State Depart- ment's determination of regional housing needs were in conflict with that of cities or counties. Councilman Tyrell moved that staff prepare the appropriate corres- pondence opposing AB -1599, seconded by Councilman Atkins and unanimously carried. B. Earthquake Preparedness Workshop City Manager Koski thanked Councilman Tyrell for the fine job he did as M.C. at the workshop program. Over 200 residents attended the workshop and approximately 600 books on "How to Survive an Earthquake" were distributed. It is proposed that additional booklets be purchased at a cost of $1.75 per booklet for avail- ability to residents at $1.00 each and added to the cost of the workshop. Councilman Tyrell moved to approve the purchase of an additional 600 booklets to be available at a cost of $1.00 each for residents, authorized the expenditure of the workshop in the amount of $2440 and amended the adopted budget accordingly, seconded by Councilman Swain and unanimously carried. C. SB -575 "Deep Pocket" Liability. Councilman Dennis brought to the council's attention, a renewed legislative effort wherein a city if only 1% liable can be held accountable for the entire 100% liability if it is not obtainable from any of the other defendants who were actually responsible. Councilmembers requested staff to prepare the appropriate letter to all committee members, representatives, and the Chamber in support of the renewed bill. D. Councilmembers concurred in their recognition of the outstand- ing job Councilman Tyrell performed during this past year as Mayor and expressed their appreciation for the countless hours he expended.
