AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING
THE FINAL SUBDIVISION PLAT OF CEDAR WOODS ON THE CREEK SUBDIVISION, A
SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, Richard S. and Joanna C. Groner, owners of the real estate hereinafter
described, having submitted to the City Council a plat of said real estate, being located in Jefferson
City, Cole County, Missouri, and being part of the Southwest Quarter of the Northeast Quarter of
Section 21, Township 44 North, Range 11 West, in the City of Jefferson, Cole County, Missouri,
more particularly described as follows: Part of Tract 2 of a Parcel Division recorded in Book B,
Page 62 Cole County Recorder's Office being part of the Southwest Quarter of the Northeast
Quarter of Section 21, Township 44 North, Range 11 West, in the City of Jefferson, Cole County,
Missouri, more particularly described as follows: From the northeast corner of the Southeast
Quarter of the Northeast Quarter of said Section 21; thence S83 052'09"W, along the Quarter
Quarter Section Line, 825.00 feet to the northwest corner of a tract described by deed of record in
Book 123, Page 413, Cole County Recorder's Office and said corner being the northeast corner of
another tract described in Book 127, Page 239, Cole County Recorder's Office; thence continuing
S83 052'09"W, along the Quarter Quarter Section Line, 661.93 feet to the southeast corner of Lot
No. 324 of LANDWEHR HILLS SUBDIVISION SECTION 10, as per plat of record in Plat Book 11,

WHEREAS, it appearing that said plat has been fully and properly signed and accepted by
the owner of said subdivision, known and referred to as the Final Subdivision Plat of Cedar Woods
On The Creek Subdivision, that all taxes have been paid, that in all respects the requirements of
Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said
subdivision, and that in all respects the requirements of the Planning and Zoning Commission of
the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the Final Subdivision Plat of Cedar Woods On The Creek Subdivision,
• lying, being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by
the said plat attached hereto and made a part of this ordinance, is hereby approved and accepted
by the City Council of the City of Jefferson, Missouri.
• SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

• Case No. P08035— 2345 Expressview Drive, Final Subdivision Plat of Cedar Woods on the
Creek Subdivision. Application filed by Richard Groner, property owner, for a final plat of 14.53
acres on land zoned RS-2 Single Family Residential. This proposed final plat includes 9
residential lots. The property is located on the northern side of Expressview Drive immediately
adjacent to and north of the intersection of Expressview Drive and Highway 50/63. The property
is described as part of the Southwest Quarter of the Northeast Quarter of Section 21, Township
44 North, Range 11 West, City of Jefferson, Cole County, Missouri. (Central Missouri

Mr. Barron explained that the subject property is located at the intersection of Expressview Drive
and Highway 50/63. He stated that the applicant is proposing a nine (9) lot residential subdivision on
14.53 acres of land.
Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding
this request. Mr. Bates distributed a reduced copy of the final subdivision plat. He explained that the
preliminary plat was approved by the Planning and Zoning Commission in August, 2008. Mr. Bates
stated that a larger tract located at the southwest corner of the property was recently separated from
the nine remaining lots. He explained that sidewalks are not an issue to address tonight because the
City Council is currently reviewing the sidewalk ordinance and whatever they determine will be
acceptable.
No one spoke in opposition to this request. No correspondence was received in opposition or in
favor of this request.

• Mr. Barron gave the Planning Division staff report and reiterated that the Preliminary Subdivision
Plat was recently approved by the Commission. He explained that at the time of Preliminary Plat
approval, a variance was granted in order to allow for a cul-de-sac that is approximately 1000 feet
long, which exceeds the maximum allowed cul-de-sac length of 800 feet. Mr. Barron stated that a
parcel division dividing off the largest lot shown on the preliminary plat was administratively approved
on October 21, 2008. He explained that the final subdivision plat would establish the remaining nine
(9) lots and right-of-way. Mr. Barron explained that one new street named Cedar Creek Court is
proposed. He stated that the applicant has requested a variance from the sidewalk requirement along
Cedar Creek Court.
Mr. Wade gave the Engineering Division staff report and explained that infrastructure exists to
serve the subdivision. He stated that new infrastructure is being proposed to serve the proposed lots
in the subdivision. Mr. Wade explained that Expressview Drive is a two lane roadway with no center
turn lane and that the Missouri Department of Transportation (MoDOT) will need to permit any work
proposed on highway right-of-way. He stated that once the improvements are completed, MoDOT
has indicated that the new extension of Expressview Drive will become a City maintained facility.
Ms. McMillan clarified that, in this instance, if the City Council grants the variance to the sidewalk
requirement then staff will process the improvement plans without the sidewalks, this does not have
to come back to the Commission. She explained that if the City Council does not grant the sidewalk
variance then sidewalks would have to be installed as part of the subdivision.
Mr. Jordan moved and Mr. Yarnell seconded to recommend approval of the Final Subdivision Plat
of Cedar Woods on the Creek Subdivision to the City Council subject to the incorporation of
comments and technical corrections of the Engineering Division and issues pertaining to the sidewalk
variance. The motion passed 7-0 with the following votes:

Background
This Major Subdivision Plat is for a new residential subdivision. The Preliminary Plat for this subdivision was
approved by the Planning and Zoning Commission on August 14, 2008. At the time of Preliminary Plat approval, a
variance was granted in order to allow for a cul-de-sac that exceeds the maximum allowed cul-de-sac length of 800
feet(the cul-de-sac is approximately 1000 feet long).
A parcel division dividing off the largest lot shown on the preliminary plat was administratively approved on October
21, 2008. This final plat would establish the remaining 9 lots and right-of-way.

ENGINEERING STAFF RECOMMENDATION-
Support approval of the proposed subdivision plat, subject to minor technical revisions as
per our current review of the resubmitted plat and improvement plans.
Infrastructure Summary
* Infrastructure exists to serve the subdivision. Streets, storm sewers, and sanitary sewers
exist to serve the subdivision. New infrastructure is being proposed to serve the proposed
lots in the subdivision.
Storm Water/Erosion Control
* Storm water and erosion control plans have been submitted for the subdivision, and are
currently being reviewed.
Sanitary Sewer
* The development is proposed to be served by sanitary sewer, each lot having access to a
City.maintained sewer main.
Sidewalk

Streets /Traffic Impact
* Expressview Drive is a two (2) lane roadway with no center turn lane along a portion of
the frontage of the proposed subdivision, no parking allowed. MoDOT will need to
