CITY OF MEDINA
RESOLUTION NO. 97- 50
RESOLUTION AUTHORIZING EBERT, INC. TO PERFORM WORK
ON THE SIDEWALK AND ENTRYWAY OF MEDINA CITY HALL
WHEREAS, The city authorized staff to apply for a Community Development Block
Grant(CDBG) to remove architectural barriers and install a sidewalk in compliance with the
American With Disabilities Act, and;
WHEREAS, The city council held a public hearing on this matter on March 6, 1996 and
thereafter, authorized staff to proceed with this project, and;
WHEREAS, The city council has determined that the lowest responsible bid is a quote from
Ebert, Inc. in the amount of $16,498, and;
WHEREAS, The bid from Ebert, Inc. will be increased to $16,748 to provide for Minnesota
State Statute 574.26 requiring contractors to provide a performance and payment bond on
any project over $10,000, and;
WHEREAS, The city wishes to award a contract to Ebert, Inc. for performing the work on the
city sidewalks and entryway.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Medina, of Hennepin
County, Minnesota, does hereby ordain as follows:
1. Authorize Ebert Inc. of the City of Corcoran to perform the work associated with the
removal of the existing sidewalk, installation of the new sidewalk and electrical door
opener, and removal of the architectural barriers in the amount of $ 16,748.
2. That the Scope of Work associated with this project shall include the following:(see
exhibit A)
a) Remove and dispose of 1,192 sq. ft. of existing concrete sidewalk.
b) Remove and dispose of 112 linear feet of concrete curb.
c) Remove and dispose 9 sq. ft. asphalt ramp material.
d) Prepare 1,220 sq. ft. of compacted granular material, to a 6 inch depth.
e) Install 112 feet of B6-12 concrete curb with a curb cut to match east handicap
assessable sidewalk, in accordance with ADA accessibility standards.
f) Asphalt patching as needed.
g) Install 1,223 sq. ft. of concrete sidewalk. Match to curb cut and to existing sidewalk
and building.
i) East Sidewalk - The slab outside the east door shall remain. Thereafter,
the sidewalk shall be installed at a 5% grade for 15 feet, at that point a 5ft
flat slab shall be installed and a new side walk shall angle to the east at a
50/0 grade to the parking lot. Another sidewalk shall follow the existing
sidewalk path at and even slope to the curb.

ii) West Sidewalk - The slab outside the door shall remain. Thereafter, the
sidewalk shall be at an even slope to the curb.
h) All concrete sidewalks shall be a minimum of 4000 psi air entrained, 4 inches thick,
with 1/2 inch reinforcing rods at one foot intervals(each way). Rods shall be
suspended at mid -slab. There shall be a joint slab cut a minimum of every 5 feet;
an expansion joint every 15 feet. The finish shall be smooth trowied with a
broomed finish.
i) Installation of Horton Series 7000 (or equivalent) door opener (including electrical
work), with ANSI A156.19 and Horton C-1315-1 (or equivalent) push button
switches(hard wired), both inside and out. Outside switch shall be mounted on a
4" x 6" bronze colored aluminum tube. (Contractor should provide a copy of the
specifications for the opener). Decal must be placed on door, visible from either
side, instructing user as to the operation of the door and all and operation of the
door opener
j) Installation of a 12" x 18" white on blue entrance sign (MNH #4) mounted on a 4" x
4" cedar post.
k) The contractor must restore disturbed lawn and landscaping back to its original
condition.
I) Contractor shall remove interior planters, tile floor, where planter previously
existed, to match existing tile, and finish wall along the inside of the exterior wall
with a panel to match existing wood trim. (city will retain usable bricks)
3. That Ebert, Inc. comply with the requirements of the Community Development Block Grant
and the city for this project, named "Labor Relations Project No. 97MN405A00007", as
included in the Bid Packet.
4. That in addition Ebert, Inc. must:
a) Complete all outside work by October 17, 1997 and inside work by November 24,
1997 before the city will issue final payment for this project.
b) Apply for a building permit and comply with all of the building codes and
regulations of the city.
c) Perform construction in a way that maintains access to city hall during business
hours.
d) Guarantee all labor and equipment for one year.

The motion for the adoption of the foregoing resolution was duly seconded by member
Zietlow and upon vote being taken thereon, the following voted in favor thereof: Ferris,
Hamilton, Johnson, Thies, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
