CITY OF MEDINA
RESOLUTION NO. 97-52
RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO JODY CHANIN
WHEREAS, Jody Chanin (the "Applicant") is the fee owner of property located at 32 Hamel
Road (the "Property"); and
WHEREAS, the Applicant has requested a conditional use permit to operate an antique store
with office and storage space at the Property; and
WHEREAS, the Property contains an existing building and is zoned urban commercial; and
WHEREAS, the Applicant's proposed use of the Property is allowed in the urban commercial
district by a conditional use permit; and
WHEREAS, this matter was reviewed by the planning commission at its meeting on
September 9, 1997 and by the city council at its meeting on October 7, 1997; and
WHEREAS, based on said review, the city council has determined that granting the Applicant
a conditional use permit for the stated purpose will not adversely affect the development of adjacent
property.
NOW, 'I HEREFORE BE IT RESOLVED by the city council of the City of Medina,
Minnesota, that a conditional use permit be granted to the Applicant for the purpose of operating an
antique store with office and storage space at the Property, subject to the following terms and
conditions:
1. The Applicant and the City acknowledged that there is an existing building on the
Property which is currently used for commercial purposes;
2. All exterior lighting at the Property must be shoebox style and totally enclosed on all
sides, except the bottom, with the globe not exposed;

3. The building on the Property must meet building and fire codes;
4. The parking area must be covered with a hard surface approved by the public works
director no later than July 1, 1998;
5. The driveway location must be approved by the public works director;
6. The building and grounds must be maintained in good condition;
7. No outside speakers, bells, or ringers are allowed on the Property;
8. There shall be no outside storage on the Property of any kind;
9. Two parking spaces in front of the building on the Property are permitted but they
must be parallel with the front of the building; and
10. The Applicant must pay to the City an administrative fee in an amount determined by
the City to represent its costs in reviewing this conditional use permit.

The motion for the adoption of the foregoing resolution was duly seconded by member Hamilton and
upon vote being taken thereon, the following voted in favor thereof.
Ferris, Hamilton, Johnson, Thies, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
