CITY OF MEDINA
RESOLUTION NO.97-55
RESOLUTION GRANTING A LAND ALTERATION PERMIT
FOR THE MEDINA MORNINGSIDE DITCH PROJECT
WHEREAS, the city of Medina (the "City") intends to conduct a ditch improvement project
on property owned by Daniel and Wanda Roach, which property is legally described on Exhibit A
attached hereto (the 'Roach Property"); and
WHEREAS, in order to accomplish the ditch project, the City intends to excavate fill from
adjacent property owned by Paja, Inc., which land is legally descried on Exhibit B attached hereto (the
"Keller Property"); and
WHEREAS, the ditch project is expected to involve excavating, moving and depositing
approximately 4000 cubic yards of fill; and
WHEREAS, the plans and specifications for the project have been prepared by the staff and
reviewed by the city council in connection with other matters involving the parties; and
WHEREAS, section 828.17 of the Medina code of ordinances requires the issuance of a land
alteration permit by the city council under the circumstances.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that a land alteration permit be granted to the city of Medina for the above purposes.

The motion for the adoption of the foregoing resolution was duly seconded by member Thies and upon
vote being taken thereon, the following voted in favor thereof:
Ferris, Thies, and Zietlow
and the following voted against same: None Absent: Hamilton, Johnson
Whereupon said resolution was declared duly passed and adopted.
