CITY OF MEDINA
RESOLUTION NO.97-56
RESOLUTION ADOPTING ASSESSMENT ROLL FOR
TOWER DRIVE STORM SEWER IMPROVEMENT
PROJECT
WHEREAS, the city council of the city of Medina, Minnesota (the "City") has proposed to
install a 12 inch storm sewer and catch basins in Tower Drive (the "Improvement Project") in order to
remedy drainage problems in that general area; and
WHEREAS, the Improvement Project is being implemented for the benefit of the owners of
specific properties (the "Benefitted Properties"); and
W H H REAS, the owners of the Benefitted Properties have signed petition and waiver
agreements (the "Agreements") waiving hearing and notice of hearing levying the special assessments
(the "Special Assessments"); and
WHEREAS, the City now intends to proceed to levy the Special Assessments against the
Benefitted Properties in reliance on the Agreements.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, as follows:
1. The Special Assessments are hereby levied against the Benefitted Properties as
specified in Exhibit A attached hereto. The Special Assessment shall be payable over a period of two
years at an interest rate of 8%;
2. The clerk -treasurer is authorized and directed to certify the Special Assessments to
Hennepin County for collection on the taxes on the Benefitted Properties payable beginning in 1998;
3. The clerk -treasurer and other city staff are authorized and directed to take any and all
other steps necessary or convenient to accomplish the purposes of this resolution.

The motion for the adoption of the foregoing resolution was duly seconded by member Hamilton and
upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Thies, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
