HomeMy Public PortalAbout1997-058Member Jim Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.97-58 RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO JOHN T. REIS, INC. WHEREAS, John T. Reis, Inc., dba Thorpe Distributing Company (the "Applicant") owns and operates a warehouse facility on its property legally described as Lot 1, Block 1, Thorpe Distributing Company Addition; and WHEREAS, by resolution no. 93-58, the city council granted a conditional use permit to the Applicant in 1993; and WHEREAS, the Applicant has requested an amendment to the conditional use permit to allow expansion of the warehouse facility; and WHEREAS, the planning commission considered the matter at its meeting on November 10, 1997 and recommended approval thereof with conditions; and WHEREAS, the city council reviewed the same at its meeting on November 18, 1997 and determined that the proposed expansion will not impede the development of adjacent property for purposes for which it is zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota that an amended conditional use permit be granted to the Applicant, subject to the following conditions: I. Following completion of the addition, the Applicant's building shall not exceed 84,000 square feet. This figure is based on the expansion of the NURP ponds and also recognizes that future expansion will be based on having adequate on -site parking. The Applicant proposes to construct approximately 10,000 square feet in the immediate future, bringing the size of the building up to approximately 65,000 square feet. Expansion beyond 65,000 square feet to the maximum permitted 84,000 square feet RHB134191 ME230-180 1 97-58 12-02-97 will require review by the planning commission; 2. There shall be no exterior storage on the site; 3. Any signs used on the property must meet city code requirements; 4. Landscaping shall remain as shown on the plan; All trash containers on the property must be screened from view from adjacent properties or rights -of -way or kept inside the building; 6. All rooftop mechanical equipment must be screened from view from adjacent properties or rights -of -way; 7 Parking must be constructed as shown on the plan; 8. All loading areas must meet code requirements and concrete and pavement areas must meet city specifications; 9. Hard surface coverage requirements must be met; 10. The number of employees shall not exceed 75 per shift; 11. All current and new exterior lighting shall be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property; 12. There shall be no outside loudspeakers or bells; 13. The building must be sprinkled throughout and fire hydrants and the fire road must be installed in accordance with the requirements of the fire department and the fire marshall; 14. The project must be approved by the Elm Creek watershed district; 15. The building must meet state building and fire codes; 16. The Applicant must sign a site improvement agreement and submit a letter of credit in the amount of $40,500 to insure completion of the site improvements; 17. The Applicant agrees to execute an amendment to the tax increment agreement with the city clarifying that increment from the building addition is not addressed by that agreement and is not Available Tax Increment as that term is defined in the agreement; and 18. The Applicant must pay the city an administrative fee in an amount determined by the RHB134191 ME230-180 2 97-58 12-02-97 city to represent its costs in reviewing this application. NOW, THEREFORE, BE IT FURTHER RESOLVED the city council of the city of Medina, Minnesota that this resolution supersedes resolution no. 93-58. Dated: December 2, 1997.
