HomeMy Public PortalAbout15-8954 Authorizing the Manager to Dispose of the Property by Sale, Development or Joint VentureSponsored by: City Manager RESOLUTION NO. 15-8954 A RESOLUTION OF CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, DECLARING SURPLUS PROPERTY; AUTHORIZING THE CITY MANAGER TO DISPOSE OF THE PROPERTY BY SALE, DEVELOPMENT, OR JOINT VENTURE; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Opa -locka owns certain surplus property that is not in use for the public benefit; and WHEREAS, it is in the public interest for the City of Opa -locka to sell or otherwise dispose of this surplus property in a manner to promote the best interests of the community; and WHEREAS, the surplus real property is attached as Exhibit "A" to this Resolution; and WHEREAS, consistent with the provisions of City of Opa -locka Resolution 08- 7317, the City Manager has conducted a good faith evaluation and analyses and provided the City Commission with a written memorandum stating the reasons why the property is to be declared surplus, attached as Exhibit "B "; and WHEREAS, The City Commission has evaluated and reviewed the Manager's report and agrees with his recommendations; and WHEREAS, The City hereby declares the property describes in Exhibit "A" as surplus property. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Resolution No. 15 -8954 Section 2. The City Commission hereby declares the property described in exhibit "A" as surplus property. Section 3. The City Commission directs the Manager to dispose of the surplus property reference herein in a manner consistent with the policy directives of Resolution 08 -7317. The Manager shall have the options of selling the property, developing the property or engaging in a joint venture Section 4. This Resolution shall take effect immediately upon adoption. Baker, Sr., City Manager DATE: March 19th, 2015 RE: Declaration of Surplus Properties Owned by the City of Opa -locks The City administration has determined that the properties identified in the document attachment should be declared as Surplus Property and therefore authorize the City Manager to Dispose of the properties for Public Benefit. A draft resolution is also attached for your review. Background In September 2012, City staff developed a document of 26 City -owned properties with photos and an assessment information of the property value from the Miami -Dade County Property Appraiser's Office. In Fall 2014, Planning & Community Development Staff conducted a review of the information on City -owned properties identified to determine the potential fiscal impact. A few of the properties were identified for parks and recreational or other municipal uses. As of today, 15 of the 26 properties have been identified as properties that the City of Opa -locka presently has no intention to use and/or developed for a municipal use. These properties, which could be assembled as 7 distinct development opportunities [based on proximity to each other], should be considered as asset to the City where these property would be sold to a for - profit entity for development. Five of the 7 distinct development opportunities are located within the Op -a -locks CRA District. These properties are not to be purchased and/or held as a means for land banking. These properties transaction will require a plan of action for development within a specified time period. No other properties owned by the City of Opa -locks are being considered for this process. The City of Opa- locka should maintain a reverter position if plans to build on these properties has not been identified, planned and/or developed within a 3 -5 year period.
