Home My Public Portal About71-063 (10-05-71) RESOLUTION N0. 71-63 , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA., CONFIRMING THE REPORT OF TIIE SUPERINTENDENT OF STREETS OF SAID CITY DATED OCTOBER S, 1971, RELATING TO CERTAIN SIDEWALK REPAIRS, WHEREAS, under the provisions of Article 2, Chapter 22, Part 3 of Division 7 0£ the Streets and Highways Code of the State of Ca,li£ornia (Improvement Act of 19ll�, the Superintendent of Streets of the City of Lynwood did duly and regularly notify the r�spective owners or persons in possession of the respective properties described in the report of sa,id Street Superintendent, herein�fter referred to, that the sidewalk or drive approach in front of such respective properties was out of repa.ir and notifying such owners or persons in possession to repair the sa.me, a11 in the manner as contemplated in said law above referred to; and WHEREAS, thereafter said owners or persons in possession of said respective properties failed to make such repairs within the time contemplated by law, or at all; and WI-IEREAS, thereafter the said Superintendent of Streets did cause the respective repairs to be made to the sidewalk in front of such respective properties and did keep a record of the cost of such repairs, including the incidental expenses thereof, and did prepare and file with the said City Council a report specifying the repairs which had been so made, the cost oP such repairs, and a, description of each parcel of rea.l property in front of which such repairs had been made and the assessment aga,inst each lot or parcel of land proposed to be levied to pay the cost thereof; and WF�EREAS, as contemplated by law, said 5uperintendent of Streets did cause notice of the said cost of such repairs to be mailed to the respective owners or persons in possession of said respective properties, a,nd did in such notices give further notice that on the 5th day of October, 1971, beginning at the hour of 7:3� o�clock p.m, in fhe Council Chambers o£ the Cify Hall of the City of Lynwood, California, the council of the said city would hear and pass upon the said report of the Superintendent of Streets of the said cost of such repairs, together with any objections or protests which might be raised by any property owner liable to be assessed for the cost and incidental expenses of making such repairs, and the objections or protests of any other interested persons; and WHEREAS, on the said 5th day of October, 1971, said city council did proceed to hold said hea.ring and did duly and regularly conduct the sa.me, all as contemplated by 1aw; and WHEREA.S, no protests or ob�ections of any kind wexe made, presented, or filed in such matter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFOFiNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE, AND ORDER A.S FOLLOWS: Section 1 . That the facts with re£erence to said matter as recited in the preamble to this resolution are true. Section 2 . That said city council does hereby confirm the report of said Street Superintendent which is on file in the office of the city clerk of said city and open to public inspection, and which is referred to and incorporated by reference herein. Section 3 . That the said council does hereby a.ssesses the respective costs of said repairs against the respective parcels o£ real property fronting upon the sidewalk upon which such respective repairs were made, all in the respective amounts, £or the respective purposes and a,gainst the respective properties as set forth and indicated in said report of said Superintendent o£ Streets on file as aforesaid, and does hereby order that unless the said respective a.mounts so assessed are respectively paid within the time limited by 1aw, the said respective amounts shall constitute and be axid here a,re respectively levied by said council as respective special assessment against the said respective parcels of real properties for the respective amounts, a11 as set forth in said report hereinabove qnoted, and as contemplated - 2 - under the provisions of said Chapter 22 of Part 3 of Division 7 - of said Streets and Highways Code, whieh said respective liens shall respectively continue until the respective assessments and al1 respective interest amounts thereon are respectively paid, or until they a.re respectively discharged of record. Section � , That said Council does hereby elect to proceed under the alternative method o£ collection provided for under the provisions o£ Section 5728 of said- Law (Improvement Act of 1911), hereinabove referred to, and does hereby autYiorize, instruct, �nd order that the Notice of Lien shall be delivered to the County Auditor of Los Angeles County, California, who shall enter the amount thereof on the County A.ssessment Book opposite the deseription of the particular property, and the amount shall be collected together with a,ll other taxes thereon against the pxoperty. Said County A:uditor, and the Assessor, and the Ta.x Collector of said County of Los Angeles who perform tax assessing and- tax collection functions for the City of Lynwood are hereby authorized, instructed, directed, and ordered to take any and all action necessary or proper on their respective pa.rts, all as contemplated under the provisions of the laws of the State of Cali£ornia in suehcases made and provided, Section 5 . Sa.id County A.ssessor, said County Tax Collector, and said County Auditor axe hereby authorized, instructed., directed, and ordered, upon receipt of such notices o£ lien, to receive the same and thereafter proceed to a.dd the respective amounts of the respective assessments indicated in said respective not�ices of lien, as hereinabove set forth in said above report of sa.id Street Superintendent, to the next regular bill for ta;ies levied against the respective lots or parcels of land therein described or referred to, and to enter the respective amount thereof on the County Assessment Book opposite the respective description o£ the respective particular properties described and referred to in sa,id respective notices o£ lien as set forth in - 3 - said report, and the respecfive a,mounts thereof shall be collected with all other taxes thereon against the respective properties described. Said County Officers, and each of them, are hereby £urther authorized, instructed, directed, and ordered to perform any further acts on their respeetive parts, a11 as contemplated under the la,w in such ca,ses made and provided. Section 6 . That this resolution shall take effect immediately. Section 7. That the city clerk shall certify to the passage and adoption of this resolution; shall make a minute of the passage and adoption thereof in the records of the proceeding� of the city council of said city in the minutes of the meeting at which time the same is passed a,nd adopted; sha11 enter the same in the Book of original resolutions of said city; and shall cause a certified copy thereof to be delivered to each of said respective county officers above named, PASSED, APPROVED, A.ND A.DOPTED this 5th day of October, 1971. 0 0� ATTEST = ,.. : 1 ;� „C � ��%� ��"f'��x�; `�� o0 - �+ - STATE OF CALIFORNIA ) . ss.
